Marshall, Deputy County Manager <br />CC: Kyle Bilafer, Area Manager; Rich Koch, County Attorney <br />Date: 10/26/2016 <br />Re: Rob Wallace Park Additional Properties Purchase <br />The purpose of this memorandum is to outline the proposed purchase of additional property for Rob <br />Wallace Park to replace the land sold to IPG and to aid in the construction /access for the park. One <br />group of parcels, referred to as the Thompson land, consists of three parcels totaling 39 acres on the <br />south side of Muddy Creek adjacent to the park. The second property is owned by the Wallace family <br />and was purchased as they assembled property to provide and construct a new access to the park <br />from Bethel School Road. That property is 3 acres. <br />The Thompson tracts are currently under option for purchase by the Wallace family and that option is <br />transferrable. The basic terms of the current option are for a payment of $260,000 at purchase with the <br />remainder of the purchase price ($220,000) being paid over five years with 5% interest. The owner is <br />elderly and has requested life time rights as well as 12 — 18 months for her son to vacate the property <br />upon her demise. The proposal the County has discussed with the Wallaces (as the option holder), and <br />through them with the owner, is for a payment of $260,000 at purchase with payments of $49,000 per <br />year for five years beginning in FY 2017. This would be considered a no interest purchase and would <br />total $505,000 which is the current tax value for the land. The terms of the life time rights would be the <br />same except we are requesting only 12 months to vacate the property. The property is in the present <br />use value program and the owner would be responsible for payment of the past 3 years taxes based <br />on full property value. <br />The second tract on Bethel School Road is small but is very important for access, utilities and future <br />park use. The Wallace family paid $160,000 for the property in 2015 and has since had additional costs <br />for taxes and insurance. The property exchange between the County and the Wallaces that resulted in <br />the County owning the parcel on which Phase I of the park is being constructed included an additional <br />amount owed to the County by the Wallaces of approximately $52,000. Staff has discussed a purchase <br />proposal with Rob Wallace that would include payment by the County, after factoring in the $52,000 <br />credit, of $110,000 for the land. Mr. Wallace would be responsible for removal of the mobile home on <br />the property as the County cannot use that building for non - residential purposes. Since this purchase <br />was originally proposed, the need for power and data right -of -ways across it to serve the park have <br />been identified. Staff has also met with Town of Midland representatives to discuss the relocation of an <br />approved Congestion Management and Air Quality grant project to this area. That grant would permit <br />the Town, at their cost through the grant, to provide access to the park from the adjacent Saddlebrook <br />residential development. Relocating that access across this property provides a more direct and much <br />safer sidewalk access for residents into the park and would be a great benefit. <br />We are requesting permission to finalize these property purchases. The specific request is to authorize <br />the County Manager, with review and approval of the County Attorney, to complete the purchase of <br />these properties under the general costs and terms outlined above. The funds for these purchases will <br />come from the proceeds of the sale of the 40 acres to IPG. <br />Attachment number 1 \n <br />G -1 Page 199 <br />
