January 7, 2015 <br />NOTICE OF PUBLIC HEARING <br />NOTICE IS HEREBY GIVEN that the Board of County <br />Commissioners (the "Board') of the County of <br />Cabarrus, North Carolina (the "County "), will con- <br />duct a public hearing on January 20, 2015 concern- <br />ing the execution and delivery by the County of <br />one or more installment financing contracts with <br />one or more third parties (the "Contracts') to refi- <br />nance all or a portion of one or more installment <br />financing contracts previously executed and deliv- <br />ered by the County, which prior installment fi- <br />nancing contracts paid all or a portion of the costs <br />of acquiring constructing and equipping various <br />public facilities and related improvements and <br />costs (collectively the "Projects'). <br />The plan of refinancing for the one or more prior <br />installment financing contracts and the Projects <br />involves the entry by the County into the Con- <br />tracts with one or more third parties who will pro- <br />vide the County with up to $211,615,000 pursuant <br />to the terms of the Contracts, which amount will <br />be applied to provide refinancing of the one or <br />more prior installment financing contracts and the <br />Projects. The County's obligations to such one or <br />more third parties supplying financing are author- <br />ized by North Carolina General Statutes Section <br />16OA -20 and will be secured by a lien upon or se- <br />curity interest in all or some portion of the Proj- <br />ects and/or in all or some portion of the real prop- <br />erty an which the Projects are located. <br />The obligations of the County under the Contracts <br />will not be deemed to be a pledge of the faith and <br />credit of the County within the meaning of any <br />constitutional debt limitation and the Contracts <br />will not directly or indirectly or contingently obli- <br />gate the County to make any payments beyond <br />those appropriated in the sole discretion of the <br />County for any fiscal year in which the Contracts <br />are in effect. No deficiency judgment may be ren- <br />dered against the County in any action for breach <br />of the Contracts and the taxing power of the Coun- <br />ty is not and may not be pledged directly or indi- <br />rectly or contingently to secure any moneys due <br />under the Contracts. <br />PLEASE TAKE NOTICE THAT THE BOARD WILL <br />HOLD A PUBLIC HEARING CONCERNING THE PLAN <br />OF FINANCING AT 6:30 P.M., OR AS SOON THERE- <br />AFTER AS THE HEARING CAN BE HELD, ON TUES- <br />DAY, JANUARY 20, 2015, IN THE COMMISSIONERS' <br />MEETING ROOM IN THE CABARRUS COUNTY GOV- <br />ERNMENTAL CENTER, CONCORD, NORTH CAROLI- <br />NA, AT WHICH ANY PERSON MAYBE HEARD CON- <br />CERNING THE PLAN OF REFINANCING. ANY PER- <br />SON WISHING TO COMMENT IN WRITING ON THE <br />PLAN OF REFINANCING MAY DO SO BY DELIVERING <br />SUCH COMMENTS TO THE UNDERSIGNED AT 65 <br />CHURCH STREET SE, CONCORD, NORTH CAROLINA, <br />28026, WITHIN 5 DAYS FROM THE DATE OF PUBLI- <br />CATION OF THIS NOTICE. <br />Megan I.E.
