January 7, 2015 NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that the Board of County Commissioners (the "Board') of the County of Cabarrus, North Carolina (the "County "), will con- duct a public hearing on January 20, 2015 concern- ing the execution and delivery by the County of one or more installment financing contracts with one or more third parties (the "Contracts') to refi- nance all or a portion of one or more installment financing contracts previously executed and deliv- ered by the County, which prior installment fi- nancing contracts paid all or a portion of the costs of acquiring constructing and equipping various public facilities and related improvements and costs (collectively the "Projects'). The plan of refinancing for the one or more prior installment financing contracts and the Projects involves the entry by the County into the Con- tracts with one or more third parties who will pro- vide the County with up to $211,615,000 pursuant to the terms of the Contracts, which amount will be applied to provide refinancing of the one or more prior installment financing contracts and the Projects. The County's obligations to such one or more third parties supplying financing are author- ized by North Carolina General Statutes Section 16OA -20 and will be secured by a lien upon or se- curity interest in all or some portion of the Proj- ects and/or in all or some portion of the real prop- erty an which the Projects are located. The obligations of the County under the Contracts will not be deemed to be a pledge of the faith and credit of the County within the meaning of any constitutional debt limitation and the Contracts will not directly or indirectly or contingently obli- gate the County to make any payments beyond those appropriated in the sole discretion of the County for any fiscal year in which the Contracts are in effect. No deficiency judgment may be ren- dered against the County in any action for breach of the Contracts and the taxing power of the Coun- ty is not and may not be pledged directly or indi- rectly or contingently to secure any moneys due under the Contracts. PLEASE TAKE NOTICE THAT THE BOARD WILL HOLD A PUBLIC HEARING CONCERNING THE PLAN OF FINANCING AT 6:30 P.M., OR AS SOON THERE- AFTER AS THE HEARING CAN BE HELD, ON TUES- DAY, JANUARY 20, 2015, IN THE COMMISSIONERS' MEETING ROOM IN THE CABARRUS COUNTY GOV- ERNMENTAL CENTER, CONCORD, NORTH CAROLI- NA, AT WHICH ANY PERSON MAYBE HEARD CON- CERNING THE PLAN OF REFINANCING. ANY PER- SON WISHING TO COMMENT IN WRITING ON THE PLAN OF REFINANCING MAY DO SO BY DELIVERING SUCH COMMENTS TO THE UNDERSIGNED AT 65 CHURCH STREET SE, CONCORD, NORTH CAROLINA, 28026, WITHIN 5 DAYS FROM THE DATE OF PUBLI- CATION OF THIS NOTICE.
