the Town of Mount Pleasant desires to reserve all right, title, and interest in any <br />WHEREAS, public or private utility improvement or easement within said portion of North <br />Drive until such time that said easement and/or associated improvement is <br />relocated and the entity holding an interest in such relinquishes it's rights; and <br />WHEREAS, it appears to the Board of Commissioners that closing said portion of North. <br />Drive is neither detrimental nor contrary to that particular public interest of <br />establishing a public school on said portion of North Drive and that no individual <br />owning property in the vicinity of said road would by virtue of such closing be <br />deprived of all reasonable means of ingress and egress to his property. <br />NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners for the Town of <br />Mount Pleasant, North Carolina as follows: <br />Section 1. That pursuant to N.C. Gen. Stat. § 160A -299, said portion of North Drive <br />in Mount Pleasant, Cabarrus County, North Carolina, more particularly described as follows, <br />shall be closed to public use: <br />LYING AND BEING IN THE TOWN OF MOUNT PLEASANT, NUMBER S <br />TOWNSHIP, CABARRUS COUNTY, NORTH CAROLINA, NORTH OF NORTH <br />CAROLINA HIGHWAY 49 AND WEST OF N. MAIN ST, BEING A PORTION OF <br />THE PROPERTY CONVEYED TO CABARRUS COUNTY (DB. 9544, PG. 34), <br />BEING A 40 FOOT STRIP OF LAND AND BEING A PORTION OF NORTH DRIVE <br />ROAD AS IT CROSSES THE PROPERTY OF CABARRUS COUNTY (DB. 9544, PG. <br />34) AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: <br />BEGINNING AT A #5 REBAR ON THE NORTH SIDE OF NORTH DRIVE, SAID <br />POINT BEING ON THE EASTERN LINE OF ERIC SMITH PROPERTIES LIMITED <br />(DEED BOOK 2265 AT PAGE 1, LOT 12, MAP BOOK 32 PAGE 94), SAID POINT <br />BEING A POINT ON THE PROPERTY LINE OF CABARRUS COUNTY (DB. 9544, <br />PG. 34).
