1. to not arbitrarily require the cessation of all nonconformities but instead, <br />provide a process whereby owners /operators of negligible nonconformities can <br />possibly continue to use and operate including expansions and alterations after <br />review by the Zoning Administrator; <br />2. to encourage the cessation (stopping) of those nonconformities, the negative <br />effects of which cannot otherwise be mitigated; and, <br />3. to phase out those nonconformities which must be eliminated in such a manner <br />as to avoid unjust economic hardship for their owners. <br />Section 14 -5 Nonconforming land /lots <br />A. Subdivision <br />Nonconforming land may not be subdivided except for purposes and in a <br />manner conforming to district regulations. <br />B. Use of single nonconforming lot <br />Any lot of record which is nonconforming may become the site of any use <br />permitted within its zoning district as long as it can meet setback requirements <br />and all other zone related development requirements. <br />C. Lots made nonconforming as a result of public taking or court order <br />If a lot becomes nonconforming through no fault of the owner, for example, as a <br />result of losing square footage by public taking or court order, while still <br />recognized as nonconforming, it may be used and developed in accordance with <br />the design standards of its district nor will it be required to be combined. <br />D. Nonconforming lots of 10,000 square feet or more <br />Any lot 10,000 square feet or more in area in a platted residential subdivision will <br />be viewed as a conforming lot even it its zoning district requires more square <br />footage. It need not be combined. Instead, it may be used and developed in <br />accordance with the design standards of the medium density open space <br />subdivision option si^'^^+;^' ieR distF;G+ <br />E. Nonconforming lots of less than 10,000 square feet <br />When lots become undersized as a result of the passage of this Ordinance in <br />zones where the minimum is 10,000 square feet or more and the lot contains <br />less than 10,000 square feet, any lot in common ownership with continuous lot <br />frontage with another undersized lot will be considered a single zoning lot. <br />P irthermere, However, before a zoning compliance permit authorizing their use <br />can be issued, lot area and width requirements for the district in which the lots <br />are located must be satisfied. <br />Attachment number 7 \n <br />G -4 Page 444 <br />
