Policy on Alcohol Sales and Use on County Property <br />The Board of Commissioners discussed the sales and use of use alcohol on County property at a work <br />session. The following summary of that discussion is offered as a policy for the Board's consideration. <br />There are two areas where alcohol sales and use are already restricted and the Board of Commissioners <br />would continue those restrictions: <br />• Chapter 50 of the Cabarrus County Code of Ordinances prohibits the sales and use of alcoholic <br />beverages in County parks. <br />• Alcoholic beverages are not permitted on school property whether the property is owned by <br />Cabarrus County Schools, Kannapolis City Schools, or Cabarrus County. <br />The County leases some properties to other entities and has entered into a management agreement for <br />the operation of the Arena and Events Center. The Board of Commissioners would make it policy that <br />the sales and use of alcoholic beverages be addressed as part of any new or amended lease and the <br />Arena and Events Management agreement. The following provisions should be included as part of the <br />lease document: <br />• All Alcoholic Beverage Commission (ABC) permits would be the sole responsibility of the lessee <br />and not of the County. <br />• The lessee shall be responsible for all required insurance, including dram shop coverage where <br />appropriate, as determined by the County Risk Management Division and /or the County <br />Attorney. <br />• Where the lease indicates that the County retains certain rights to use of specific areas, the <br />lessee would need to request use of that area from the County Manager and receive approval <br />for that use prior to any event. All ABC permits for an event would be the responsibility of the <br />lessee and would need to specify the approved area. <br />• The Food & Beverage Agreement for the Arena and Events Center addresses the sales and use <br />of alcohol on the Arena property. That agreement is based on a past approval granted by the <br />Board of Commissioners permitting those sales through the Food and Beverage vendor. <br />G -1 Page 202 <br />
