CABARRUS COUNTY BOARD OF COMMISSIONERS <br />POLICY ON SALE AND USE OF ALCOHOL ON COUNTY PROPERTY <br />INTRODUCTION. <br />Cabarrus County does not have a comprehensive policy on the sale and use of alcohol on County - <br />owned or County - leased property. At its September 8, 2015 work session, the Board of Commissioners <br />discussed this issue and by consensus determined that enactment of a policy on sale and use of alcohol on <br />County property would be beneficial. <br />There are two areas in which previously enacted laws govern sale and use of alcohol on County <br />property. Section 50 -4 of the Cabarrus County Code of Ordinances prohibits the possession of alcoholic <br />beverages in any of the County's parks. N.C. Gen. Stat. § 18B- 301(f)(7) prohibits the possession or use of <br />alcohol on school property used for school purposes. <br />Thus, the remaining issue of alcohol sale and use on other County properties is subject to Board <br />action, either in individual circumstances previously determined or future regulation. <br />POLICY <br />It is the policy of this Board and subsequent boards of commissioners, unless changed by such <br />board, that alcoholic beverages shall not be possessed, used, or consumed on County -owned or County - <br />leased property, unless allowed at the discretion of the Board or under one of the following exceptions or <br />situations: <br />1. By specific contract or lease agreement with a tenant. For example, the County has a <br />contract with SMG for management of the Cabarrus Arena and Events Center that allows for alcohol sale <br />and use under certain conditions, and the County has a lease with the Arts Council and Historic Cabarrus <br />Association for the Historic Cabarrus Courthouse that allows for alcohol sale and use under certain <br />conditions. <br />2. In future contracts and lease agreements, the County will require the following provisions <br />be a part of any such document: <br />a) All North Carolina Alcoholic Beverage Commission ( "ABC ") permits shall be <br />the sole responsibility of the lessee or contractor. <br />b) Such lessee or contractor shall be responsible for and indemnify the County for <br />all liability relating to sale and use of alcohol, and shall obtain premises and liability insurance for such <br />risks, including dram shop coverage, as determined by the County Risk Manager and the County <br />Attorney. <br />C) Where the contract or lease provides that the County retains the right to control <br />certain areas of County property, the contractor or lessee must obtain the written permission of the <br />County Manager or his designee in advance of the use of such area for the sale or use of alcohol. Such <br />permission may be denied, or the decision deferred to the Board of Commissioners at the discretion of the <br />Attachment number 1 \n <br />F -1 Page 49 <br />
