CABARRUS COUNTY <br />r <br />BOA C <br />REGULAR MEETING <br />#C 1' <br />¢� Cr1IZ�y j ,to AUG 1 8 <br />m'w/ICI! , 2014 <br />AGENDA CATEGORY: <br />New Business <br />SUBJECT: <br />Active Living and Parks - Department Ordinance Related to NCGS 14- <br />415.23 <br />BRIEF SUMMARY: <br />The North Carolina General Statutes (NCGS) have been amended <br />regarding concealed carry permit holders, allowing those possessing a <br />concealed carry permit to carry guns in local parks. The statute permits <br />local jurisdictions to identify specific areas in which concealed carry permit <br />holders are not allowed to carry, dependent on the governing body <br />adopting an ordinance prohibiting concealed carry in specific areas and <br />installing signs. <br />The areas where concealed carry can be restricted are: pools - including <br />the attached amenities; recreation facilities - including areas with <br />gymnasiums; and athletic facilities - including bleachers, restrooms, <br />concession areas and parking areas in close proximity. <br />Concord and Kannapolis have adopted an ordinance prohibiting the <br />concealed carry of firearms in those three defined areas of their parks. <br />The open carry of firearms can be prohibited in public places. The Active <br />Living and Parks Department Ordinance currently prohibits firearms in <br />parks, although it is not being enforced in a manner consistent with <br />adopted statutes. Since the ordinance is in contradiction to statutes, the <br />Active Living and Parks Ordinance needs to be updated to reflect statute <br />changes for compliance with new general statutes (concealed carry) <br />and /or to regulate existing ones (open carry). <br />* Note: The updated ordinance was not available at the time of agenda <br />distribution.
