Drawn By: Concord Deputy City Attorney <br />Return to Cabarrus County Register of Deeds, ROD Box <br />STATE OF NORTH CAROLINA Parcel #: 4681 -15 -7264 <br />COUNTY OF CABARRUS Grant of Greenway Permanent Easement & Access Easement <br />The undersigned Cabarrus County, a body politic and political subdivision of the State of North Carolina, <br />Grantor, in consideration of payment to the Grantor of the sum of One Dollar, ($1.00), the receipt and sufficiency of <br />which is hereby acknowledged, does hereby grant, bargain, sell and release unto the City of Concord, a North Carolina <br />municipal corporation ( "Grantee "), its successors, assigns and licensees, the right, privilege, access, and easement to <br />enter and re -enter at any time for public access, including but not limited to public active or passive green space, <br />greenway, park, parking lot, and recreational purposes, to install, dig, build, erect, maintain, repair, rebuild, operate, and <br />patrol said public access, green space, greenway, park, or parking lot and the right, privilege and easement to enter and <br />re -enter at any time to install, dig, build, erect, maintain, repair, rebuild, operate, and patrol such public use as set forth <br />herein, such as, but not limited to green space, greenway, park, or parking lot; the right to clear the easement and access <br />and keep it clear of brushes, trees, buildings, obstructions, and fire hazards; and the right to remove trees, if any, located <br />beyond the limits of the easement and access easement, but which interfere with the easement and access; the above <br />described rights being incident to performance by the Grantee of its functions as a municipality, or the performance by <br />any licensee of the Grantee of a public function, the premises being located in No. 3 Township, Cabarrus County, North <br />Carolina, and described in the metes and bounds description below: <br />A Variable Width Permanent Greenway Easement Area <br />Lying and being in the City of Concord, No. 3 Township, Cabarrus County, North Carolina, crossing Deed Book <br />3159, Page 61 (PIN: 4681 -15 -7264) as recorded among the Cabarrus County Register of Deeds; and being more <br />particularly described as follows: <br />Beginning at a computed POINT in the existing concrete sidewalk on the West side Public Right -of -Way (50' wide) <br />of Moss Farm Street, NW, said POINT having NC (NAD 83) Ground Coordinates of N: 615,804.7519, E: <br />1,482,019.6824 and being situated South 43 °30'17" East 414.34 feet from an existing Monument "RC41" located at <br />the northwest corner of Conservation Easement AREA #4 as shown and recorded in Map Book 57, Page 83. Said <br />POINT being further described as being situated South 25 °03'21 " West 4,479.72 feet (ground) from NCGS <br />Monument "ORCHARD" and being the POINT OF BEGINNING (POB) of the Variable Width Permanent <br />Greenway Easement Area to be described herein; thence leaving the POINT OF BEGINNING (POB) and running <br />along the aforesaid West side Public Right -of -Way of Moss Farm Street, NW <br />1. South 33 °01'49" East 27.23 feet to a point; thence <br />2. South 34 °32'41" East 27.23 feet to a point; thence <br />3. South 36 °02'10" East 26.39 feet to a point thence leaving said West side Public Right -of -Way of Moss <br />Farm Street, NW and running across Deed Book 3159, Page 61 (PIN: 4681 -15 -7264) <br />4. 39.41 feet (C2) along the are of a non- tangent curve deflecting to the right, having a radius of 47.85 feet <br />and a Chord Bearing and Distance of South 25 °20'48" West 38.31 feet to a point thence <br />5.
