SECTION IiI <br />Applicable Laws <br />A. Title VII of the Civil Rights Act of 1964 - Prohibits discrimination in any aspect of <br />employment, including "help wanted" advertising and pre -job testing, on the basis <br />of race, color, religion, sex or national origin. In 1978, the Pregnancy Discrimination <br />Act amended Title VII to prohibit Dias on the basis of pregnancy. <br />B. The Equal Pay Act or 1963 - fart of the Fair Labor Standards Act, this law prohibits <br />pay differential based on sex. <br />C. The Age Discrimination in Employment Act of 1967 - This statute prohibits <br />employment discrimination against individuals aged 40 or older. It applies to <br />employers of 20 or more workers, labor unions, and employment agencies. <br />D. The Reha Act of 1973 - Section 503 of the law prohibits discrimination <br />against handicapped persons by Federal contractors. These employers are required <br />to take Affirmative Action in hiring qualified individuals with disabilities. Section 5104 <br />of the Act prohibits discrimination against qualified individuals with handicaps by <br />institutions of programs that receive federal funds. <br />E. The Vietnam -Era Veteran's Readjustment Assistance Act of 1974 -This law requires <br />Affirmative Action by Government contractors to employ and advance in <br />employment qualified veterans of the Vietnam era and disabled veterans. <br />F. The immigration Reform and Control Act of 1986 - An amendment to the <br />Immigration and Naturalization Act, this statute prohibits employers of four or more <br />workers from discriminating on the basis of citizenship status or national origin. The <br />Act's anti - discrimination provisions do not applyto illegal aliens, and there are <br />exceptions where citizenship is required by law. <br />G. The American With Disabilities Act of 1990 - Effective in 1992, this statute prohibits <br />employment discrimination against individuals with disabilities and requires places <br />Of public services and accommodations to be usable and accessible. Employers with <br />25 or more workers are covered by the law as of July 26, 1992 and employers of 15 <br />or more workers are covered beginning July 26, 1994. There are no Affirmative <br />Action requirements under ADA. <br />H. Executive Girders - E.O. 11246 bans discrimination on the basis of race, sex, religion, <br />color, and national origin by Federal contractors in excess of $10,000.00. The order <br />includes Affirmative Action requirements. E.O. 1141 prohibits discrimination on the <br />basis of age by Federal contractors. <br />Attachment number 1 <br />5-13 Page 234 <br />
