RESOLUTION APPROVING CONVEYNANCE OF RIGHT <br />OF WAY TO NORTH CAROLINA DEPARTMENT OF <br />TRANSPORTATION; AUTHORIZING THE EXECUTION <br />AND DELIVERY OF RELATED DOCUMENTS IN <br />CONNECTION THEREWITH; AND PROVIDING FOR <br />CERTAIN OTHER RELATED MATTERS <br />WHEREAS, the County of Cabarrus, North Carolina (the "County ") is the owner of that certain <br />real property containing approximately 44.999 acres and more specifically described in Deed <br />Book 8757, page 318 of the Cabarrus County Registry (the "Subject Property "), which Subject <br />Property is situated near George Liles Boulevard. <br />WHEREAS, the North Carolina Department of Transportation ( "NCDOT ") has offered to <br />purchase a right of way over approximately 0.800 acres of the Subject Property at a purchase <br />price of $24,300.00. <br />WHEREAS, the Board of Commissioners desires to approve the proposed conveyance of the <br />right of way and purchase price and to authorize other actions in connection therewith; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CABARRUS COUNTY BOARD OF <br />COMMISSIONERS: <br />Section 1. The conveyance of the right of way of approximately 0.800 acres over the <br />Subject Property for a purchase price of $24,300.00 is hereby approved. <br />Section 2. The Chairman or Vice Chairman of the Board of Commissioners, the County <br />Manager, any Deputy County Manager, the Finance Director and the County Attorney are each <br />hereby authorized to take any and all such further action, including negotiation of any and all <br />documents related to the conveyance of the right of way and receipt of the purchase price, and to <br />F -1 <br />Page 280 <br />
