Box 690429 <br />Charlotte, NC 28227 <br />The above - listed addresses may be changed by any Party by written notice sent in accordance <br />with this paragraph. <br />XIV. <br />DEFINITIONS <br />For purposes of this Contract, "Hazardous Material" means any substance (i) the <br />presence of which requires investigation or remediation under any Applicable Law or federal, <br />state or local statute, regulation, rule, ordinance, order, action, policy or common law; or (ii) <br />which is or becomes defined as a "hazardous substance," pollutant or contaminant under any <br />Applicable Law or federal, state or local statute, regulation, rule or ordinance or amendments <br />thereto including, without limitation, the Comprehensive Environmental Response, <br />Compensation and Liability Act (42 U.S.C. section 6901 et seq.) and the Resource Conservation <br />and Recovery Act (42 U.S.C. section 6901 et seq.); or (iii) which is toxic, explosive, corrosive, <br />flammable, infectious, radioactive, carcinogenic, mutagenic, or otherwise hazardous and is or <br />becomes regulated by any Governmental Authority; or (iv) the presence of which on the Property <br />causes or threatens to cause a nuisance upon the Property or to adjacent properties or poses or <br />threatens to pose a hazard to the health or safety of persons on or about the Property; or (v) <br />without limitation which contains gasoline, diesel fuel or other petroleum hydrocarbons; or (vi) <br />without limitation which contains polychlorinated biphenyls (PCB's), asbestos or urea <br />formaldehyde insulation; and "Environmental Requirements" means any and all applicable <br />present and future federal, state or local statutes, regulations, rules, ordinances, codes, licenses, <br />permits, orders, approvals, authorizations and similar items, and any and all applicable judicial or <br />administrative decrees, judgments or orders relating to the protection of human health or the <br />environment or to the protection of the health and safety of employees or the public. <br />XV. <br />8 <br />2013 Base Option <br />Attachment number 1 <br />G -9 <br />Page 206 <br />
