RES OLUTIO N <br />K <br />�r CONSER <br />,k EXECUTIO <br />DOCUM <br />' ' • It <br />_ Ct4Rd rl1�� MATTER <br />APPROVING CONVEYANCE OF <br />ON EASEMENT; AUTHORIZING THE <br />AND DELIVERY OF RELATED <br />IN CONNECTION THEREWITH; AND <br />FOR CERTAIN OTHER RELATED <br />WHEREAS, the County of Cabarrus, North Carolina (the "County ") is the owner of that <br />certain real property containing approximately [63.81] acres and more specifically described in <br />Deed Book [8757, page 315] of the Cabarrus County Registry (the "Subject Property "), which <br />Subject Property is situated near Hickory Ridge Middle School, Hickory Ridge High School and <br />Hickory Ridge Road. <br />WHEREAS, the Soil and Water Conservation District of Cabarrus County ( "SWCD ") <br />has requested that the County grant a conservation easement over approximately 1.5 acres of the <br />Subject Property to Mogensen Mitigation, Inc., a North Carolina corporation (the <br />"Corporation "), or its assigns, at a purchase price of $1.00. <br />WHEREAS, the Board of Commissioners desires to approve the proposed conveyance of <br />the conservation easement and purchase price and to authorize other actions in connection <br />therewith; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners, as follows: <br />Section 1. The conveyance of the conservation easement of approximately 1.5 acres over <br />the Subject Property to the Corporation, or its assigns, for a purchase price of $1.00 is hereby <br />approved. <br />Section 2. The Chairman or Vice Chairman of the Board of Commissioners, the County <br />Manager, any Deputy County Manager, the Finance Director and the County Attorney are each <br />hereby authorized to take any and all such further action, including negotiation of any and all <br />documents related to the conveyance of the conservation easement and receipt of the purchase <br />G -9 <br />Attachment number 2 <br />Page 210 <br />
