(c) Final Action On Wastewater Discharge Permit Applications <br />(1) The Executive Director shall take final action on all applications not later than 90 days following . <br />receipt of a complete application. <br />(2) The Executive Director is authorized to: <br />(A) Issue a wastewater discharge permit containing such conditions as are necessary to effectuate <br />the purposes of this ordinance and N.C.G.S. 143 - 215.1; <br />(B) Issue a wastewater discharge permit containing time schedules for achieving compliance <br />with applicable pretreatment standards and requirements; <br />(C) Modify any permit upon not less than 60 clays notice and pursuant to Section 4.4 (b) of this <br />ordinance; <br />(D) Revoke or suspend a permit pursuant to Section 8. l of this ordinance; <br />(E) Deny a permit application when in the opinion of the Executive Director- such discharge may <br />cause or contribute to pass through or interference of or where necessary to effectuate the <br />purposes of N.C.G.S. 143 - 215.1; and <br />(F) Determine, based on the application, that the applicant is not an S1U. <br />(d) Permit Conditions <br />(1) The Executive Director or designee shall have W S A G the aulhurit� to grant a permit with such <br />conditions attached as he believes necessary to achieve the purpose of this ordinance and N.C.G.S. <br />143 - 215.1. Wastewater discharge permits shall contain, but are not limited to, the following: <br />(Ai) A statement of duration (in no case more than five years); <br />(Bii) A statement of non - transferability; <br />(Ciii) Applicable effluent Iirnits based on categorical standards or local limits or both; <br />(Div) Applicable monitoring, sampling, reporting, notification, and record keeping requirements. <br />These requirements shall include an identification of pollutants to be monitored„ sampling . <br />location, sampling frequency, and sample type based on Federal, State and local law. <br />(Ev) Requirements for notifying the POTW in the event of an accidental discharge or slug load as <br />defined in Section 1.2(a)(55); <br />(Fvi) Requirements to implement a plan or other controls for prevention of accidental discharges <br />and/or slug loads as defined in Section 1.2(a)(55), if determined by the Executive Director to <br />be necessary for the user ; <br />(Gvii) Requirements for immediately notifying the POTW of any changes at its facility affecting <br />the potential for spills and other accidental discharges, or slug load as defined in 1.2(a)(55). <br />Also see Sections 5.5 and 5,6; and <br />Attachment number 5 <br />H -3 Page 284 <br />
