Cabarrus county Zoning Ordinance <br />Chapter 4- Overlay Districts and Zones <br />Cabarrus Soil and Water Conservation District to assure activity and <br />compliance. Any noncompliance shall be treated as a zoning violation and be <br />subject to enforcement as described in Chapter Twelve of this Ordinance. <br />14. A minimum setback for all buildings from the buffer for waterbodies as <br />classified and defined in Section 4 -10 -1 shall be at least 20 feet. For <br />waterbodies classified and defined in Section 4 -10 -2, the setback shall be a <br />minimum of 10 feet from the buffer. If there is a difference in the zoning <br />ordinance setback and the no build buffer, the greater of the two shall apply. <br />No building or structures shall be permitted in the no build buffer area. <br />15. Where the Waterbody Buffer Zone or no build buffer impacts or is part of a <br />lot, a note shall be placed on the plat or site plan and a restriction shall <br />become part of the deed for the property stating that said property is subject <br />to the Waterbody Buffer Zone. <br />16. Applicants and property owners are strongly encouraged to consider the <br />dedication of property or easements subject to the Water Body Buffer Zone to <br />one of the following when appropriate: .. <br />o Property /Home Owners Association <br />o Cabarrus Soil and Water Conservation District <br />o A conservation organization <br />PART III THOROUGHFARE OVERLAY (TOZ) ZONE <br />The purpose of the Thoroughfare Overlay Zone (TOZ) is to help assure protection will <br />be included in all land uses developed along several key roadways. Accordingly, <br />these regulations are made with consideration to both the County's land <br />development plan and area plans. They are designed to promote the health and <br />general welfare of the residents of Cabarrus County as well as preserve property <br />values and encourage appropriate land usage.
