CABARRUS COUNTY <br />BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />NOVEMBER 18, 2013 <br />1 P.M. <br />AGENDA CATEGORY: <br />New Business <br />SUBJECT: <br />Active Living and Parks Department - Department Ordinance Related to <br />NCGS 14- 415.23 <br />BRIEF SUMMARY: <br />The North Carolina General Statutes (NCGS) have been amended <br />regarding concealed carry permit holders, allowing those possessing a <br />concealed carry permit to carry guns in local parks. The statute permits <br />local jurisdictions to identify specific areas in which concealed carry permit <br />holders are not allowed to carry, dependent on the governing body <br />adopting an ordinance prohibiting concealed carry in specific areas and <br />installing signs. <br />The areas where concealed carry can be restricted are: pools - including <br />the attached amenities; recreation facilities - including areas with <br />gymnasiums; and athletic facilities - including bleachers, restrooms, <br />concession areas and parking areas in close proximity. <br />Concord, Kannapolis and Harrisburg have adopted an ordinance <br />prohibiting the concealed carry of firearms in those three defined areas of <br />their parks. Concord has signs posted and the other two are working on <br />signs as well. <br />The open carry of firearms can be prohibited in public places. The Active <br />Living and Parks Department Ordinance currently prohibits firearms in <br />parks, although it is not being enforced in a manner consistent with <br />adopted statutes. Since the ordinance is in contradiction to statutes, the <br />Active Living and Parks Ordinance needs to be updated to reflect statute <br />changes for compliance with new general statutes (concealed carry) <br />and /or to regulate existing ones (open carry). <br />G -2 Page 112 <br />
