Exhibit A <br />Atlas Food Systems and Services, Inc <br />205 Woods Lake Road <br />Greenville, SC 29607 <br />Attn: Tony Moncini, tmoncini @atlasfoods.com <br />As part of this agreement Atlas Food Systems and Services, Inc. agrees to the following: <br />1. Frank Liske Park vending area will be provided with a 40 selection snack machines and 2 20 Oz bottle <br />coke machines. <br />2. North Cabarrus Park will have a 32 selection snack machine and 120 oz. bottle Coke machine. <br />3. Camp Spencer Park will have a 32 selection snack machine and 120 oz. bottle Coke machine. <br />4. Additional snack and drink machines will be placed at Aging, COTS, Cooperative Extension, EMS <br />Station 1, EMS Station 2, Governmental Center, GSA fleet, two locations for General Services, two <br />locations at Human Services, Courthouse, Sheriff's Animal Control and additional locations as needed. <br />Size of snack machine and drink machine will be mutually agreed upon by Cabarrus County and Atlas <br />Vending. <br />5. Machines are serviced weekly or as needed to meet the needs of the park. Service calls will be within <br />24 hours after contact. <br />6. Commissions will be paid monthly at a rate of 17% of gross sales on snacks and 22% of gross sales on <br />drinks minus sales tax for Parks vending machines. Commissions for each month will be paid by the <br />15` of the following month. Commissions for other county vending machines will be used to lower the <br />cost of items. Itemized detailed report will show sales of beverages and sales of snacks and will be <br />reconciled by each location. <br />7. Commissions for Parks should be mailed to the Parks' main office at P. O. Box 707, Concord NC <br />28026, unless notified otherwise. <br />8. Prices will be set at the approved rate (see Exhibit B). <br />9. New or like new equipment will be installed at the facilities. <br />10. Fifty percent of snacks and drinks will include items from the Fit Pick Healthy menu and will change as <br />directed by Cabarrus County Government. <br />11. Beverage and food items meeting the health guidelines must be sold at a price that is equivalent to or <br />lower than the price of items that do not meet these nutrition standards. <br />12. Items meeting healthy guidelines standards must be placed in the top third of the vending machines so <br />that they are visible at eye level. <br />13. Vending machines shall only include advertising of beverages of foods that meet the stated nutrition <br />standards. <br />14. Atlas agrees to offer products to be sold through Parks concessions. The products can be delivered on a <br />bi- weekly basis and products must be purchased by the case. <br />15. Shall be responsible for damage, repair and replacement of vending machine(s). <br />16. Shall be responsible for any theft or loss of equipment or vending supplies. <br />As part of this agreement Cabarrus County Parks Dept. agrees to: <br />1. Provide locations for vending machines. <br />2. Notify Atlas with maintenance concerns by phone and/or email. <br />3. Notify Atlas of large special events so machines can be stocked appropriately. <br />4. Allow for monthly discussions and possible menu changes on items that sell regularly and items that are <br />not selling. <br />Attachment number 1 <br />F -9 Page 228 <br />
