<br />The undersigned, Cabarrus County, a body politic and political subdivision of the State
<br />of North Carolina, Grantor, in consideration of payment to the Grantors the sum of One Dollar
<br />and other good and valuable consideration, the receipt and sufficiency of which is hereby
<br />acknowledged, do hereby grant, bargain, sell and release unto the City of Concord, a North
<br />Carolina Municipal Corporation ( "Grantee "), its successors, assigns and licensees, the right,
<br />privilege and easements to enter and re -enter at any time and to install, dig, build, erect,
<br />maintain, repair, rebuild, reconstruct, operate, and patrol one or more electric power distribution
<br />and /or transmission lines, over ground or underground, including the right to erect poles and
<br />other distribution and /or transmission line structures, wires, cables, pipes, and any necessary
<br />appurtenances for the proper conduct of electricity, electronic information, data, or
<br />communications; within the easements, the right to clear the easements and keep them clear of
<br />brushes, trees, buildings, and fire hazards; and the right to remove trees, if any, located beyond
<br />the limits of the easements, but which interfere with the easements; the above described rights
<br />being incident to performance by the Grantee of its functions as a municipality or as the
<br />operator of any public easement, or the performance by any licensee of the Grantee of any
<br />public functions, the premises being located in No. 11 Township, Cabarrus County, North
<br />Carolina, described in the metes and bounds descriptions below:
<br />A Variable Width Permanent Public Utility Easement:
<br />Lying and being in No. 11 Township, Cabarrus County, and lying to the north of Miami Church
<br />Road, and to the west of Abilene Rd. and being an easement through the property of Cabarrus
<br />County, a body politic (DB. 8757 Pg. 312) and being more particularly described as follows:
<br />Beginning at a point in the line of Scott Yancey and wife Sarah Avett (DB. 8266, Pg. 87), said
<br />point being the following four courses and distances from an existing concrete monument:
<br />1) N 50 °44'34" W 31.38 feet to a point (1-41); 2) N 68 °01'19" W 25.20 feet (1-42); 3) N 68 °37'40"
<br />W 13.38 feet to a point (1-44); and 4) N 68 0 37'40" W 69.85 feet (1-38); thence from said POINT
<br />OF BEGINNING, through the property of Cabarrus County, a body politic (DB. 8757 Pg. 312)
