(0.151 ACRES) and as shown on the survey map by CESI <br />Land Development Services dated April 15, 2010 and is hereby attached as "Exhibit C" <br />for further reference. <br />The property described herein is subject to all rights -of -way, easements and restrictions <br />of record. <br />The Grantor, by the execution of this instrument, acknowledge that the plans for the <br />above referenced project as they affect its remaining property have been fully explained to them <br />or its authorized representative, and does hereby release the Grantee, its successors, and <br />assigns from any and all claims for damages resulting from the construction of said project or <br />from the past, present or future use of said premises herein conveyed for any purpose for which <br />the said Grantee is authorized by law to subject the same. <br />Together with any and all rights normally incident thereto, and particularly the right of <br />ingress and egress thereto from time to time as necessary for construction, reconstruction, <br />enlargement and /or maintenance. <br />To have and to hold the same unto the City of Concord, its successors and assigns <br />forever. <br />This agreement shall not be interpreted to impose any duty on the City of <br />Concord, its successors and assigns to install any utilities by any particular date or <br />within any particular time frame. <br />The Grantor shall have the right to use the above - described property for purposes not <br />inconsistent with Grantee's full enjoyment of the rights hereby granted, provided that the Grantor <br />shall not erect or construct any building or other structure thereon; maintain or permit any <br />underground or over ground system of piping, poles or wiring within such property; make any <br />use of the facilities installed, buried, erected, or constructed thereon; or drill or operate any well <br />or septic system within such property, without the express written permission of the Grantee. <br />M <br />F -1 <br />Attachment number 4 <br />Page 49 <br />
