<br />COUNTY OF CABARRUS CITY OF CONCORD
<br />The undersigned Grantor, Cabarrus County, a body politic and political
<br />subdivision of the State of North Carolina, in consideration of payment to the Grantor of the sum
<br />of One Dollar, ($1.00), the receipt and sufficiency of which is hereby acknowledged, do hereby
<br />grant, bargain, sell and release unto the City of Concord ( "Grantee "), its successors, assigns and
<br />licensees, the right, privilege, and easements to enter and re -enter at any time and to install, dig,
<br />build, erect, maintain, repair, rebuild, operate, and patrol sanitary sewer public utilities, over
<br />ground or underground, including but not limited to, the right to install sewer pipes and related
<br />appurtenances; the right to clear the easements and keep them clear of brushes, trees,
<br />buildings, obstructions, and fire hazards; and the right to remove trees, if any, located beyond
<br />the limits of the easements, but which interfere with the easements; the above described rights
<br />being incident to performance by the Grantee of its functions as a municipality or as the operator
<br />of any public utilities systems, or the performance by any licensees of the Grantee of any public
<br />utilities functions, the premises to be affected hereby being more particularly described as
<br />follows:

<br />Lying and being in the City of Concord, No. 1 Township, Cabarrus County and lying to the south
<br />of Holden Avenue, and being an easement through the property of Cabarrus County (DB. 8522,
<br />pg. 77, MB. 57, pg. 18) and being more particularly described as follows:
<br />Commencing from an existing #4 rebar marking the northeast corner of Cabarrus County, (DB.
<br />8522, pg. 77, MB. 57, pg. 18) thence proceed from said #4 rebar the following SIX (6) calls
<br />through the property of Cabarrus county 1) S 52 0 58'52" W 34.38 feet (1-28) to a point; 2) S
<br />39 0 18'55" E 30.54 feet (1-30) to a point; 3) with the arc of a circular curve to the right having a
<br />radius of 510.00 feet, an arc length of 15.17 feet, and a chord bearing and distance of S
<br />38 0 27'47" E 15.17 feet (C7) to a point; 4) S 37 0 36'40" E 202.88 feet (1-31) to a point; 5) with the
<br />arc of a circular curve to the left having a radius of 140.00 feet, an arc length of 110.77 feet, and
<br />a chord bearing and distance of S 60 0 16'43" E 107.91 feet (C8) to point; 6) S 07 0 43'58" E 20.69
<br />feet (1-72) to the TRUE POINT OF BEGINNING. Thence from said POINT OF BEGINNING,
<br />through the property of Cabarrus County the following FIVE (5) courses and distances: 1) S
<br />11 °00'52" E 70.99 feet (1-71) to a point; 2) S 78 0 59'08" W 30.00 feet (1-68) to a point; 3) N
<br />11 0 00'52" W 83.19 feet (1-70) to a point; 4) with the arc of a circular curve to the left having a
<br />radius of 160.00 feet, an arc length of 27.16 feet and a chord bearing and distance of S
<br />78 0 05'00" E 27.12 feet (C5) to a point; 5) S 82 0 56'45" E 5.28 feet (1-5) to the POINT AND PLACE
<br />OF BEGINNING and containing 2,296 square feet or 0.053 acres, as shown on survey titled,
<br />"Utility and Access Easement Plat, Property of Cabarrus County," dated August 30, 2011 by
