The Grantor by the execution of this instrument, acknowledges that the plans for the above <br />referenced project as it affects the remaining property has been fully explained to its authorized <br />representative(s), and does hereby release the Grantee, its successors, and assigns from any and all <br />claims for damages resulting from the construction of said project or from the past, present or future <br />use of said premises herein conveyed for any purpose for which the said Grantee is authorized by law <br />to subject the same. <br />Together with any and all rights normally incident thereto, and particularly the right of <br />ingress and egress thereto from time to time as necessary for construction, reconstruction, <br />enlargement and /or maintenance. <br />To have and to hold the same unto the City of Concord, its successors and assigns forever as <br />to the permanent easement and to have and to hold the same unto the City of Concord, its successors <br />and assigns during the construction of the water line and its immediate environs knows as the <br />"Northern Concord - Albemarle Water Line Connection" (Project Number 2007 -031) as to the <br />temporary construction easement. <br />This agreement shall not be interpreted to impose any duty on the City of Concord, its <br />successors and assigns to install any utilities by any particular date or within any particular <br />time frame. <br />This property right may be assigned by the Grantee, or its successors. <br />The Grantor shall have the right to use the above - described property for purposes not <br />inconsistent with Grantees' full enjoyment of the rights hereby granted, provided that the Grantor <br />shall not erect or construct any building or other structure thereon; maintain or permit any <br />underground or over ground system of piping, poles or wiring within such property; make any use of <br />the facilities installed, buried, erected, or constructed thereon; or drill or operate any well or septic <br />system within such property, without the express written permission of the Grantee. <br />IN WITNESS WHEREOF these presents have been duly executed under seal by the Grantor <br />on this the day of 1 2012. <br />Cabarrus County, a Body Politic and Political <br />Subdivision of the State of North Carolina <br />ATTEST: <br />Kay Honeycutt, Clerk to the Board <br />[SEAL] <br />Elizabeth F.
