FIRST AMENDMENT AND AGREEMENT FOR LEASE EXTENSION <br />T-4p . <br />THIS AGREEMENT is made and entered into as of the 3 rj day of4aimary, 2011 by <br />and between KANNAPOLIS LAND, INC. ( "Landlord "), and CABARRUS COUNTY <br />( "Tenant "). <br />BACKGROUND <br />A. Landlord and Tenant are parties to that certain Lease dated May 1, 2006 <br />(the "Lease ") for space at unit 2, 1325 S. Cannon Blvd., Kannapolis, NC 28083 (the <br />"Demised Premises "). <br />B. The current term of the Lease expires April 30, 2011. Tenant has <br />requested an extension of the term and Landlord has agreed to grant an extension of the <br />term. <br />NOW, THEREFORE, in consideration of the mutual promises contained herein <br />and other good and valuable consideration, the receipt and sufficiency of which are <br />hereby acknowledged, Landlord and Tenant hereby agree as follows: <br />1. Extension. Landlord and Tenant hereby agree to extend the Lease Term <br />from May 1, 2011 to April 30, 2012 (the "Extended Term "). <br />2. Rent. During the Extended Term, the Annual Minimum Rental shall be <br />equal to the initial term Annual Minimum Rental ($16,800) increased by a percentage <br />equal to the total percentage increase in the CPI from May 1, 2006 to April 30, 2011. <br />3. Notice to Landlord. Section 9(f) of the Lease is amended to provide that <br />notice to Landlord shall be mailed to Kannapolis Land, Inc., c/o Hughes Investments, <br />Inc., P.O. Box 1177, Greenville, SC 29602. <br />4. Lease Ratified Except as hereby amended, the terms and conditions of <br />the Lease are ratified and confirmed by the Landlord and Tenant and shall remain in full <br />force and effect. <br />Attachment number 1 <br />F -3 Page 63 <br />
