Cabarrus County Zoning Ordinance <br />Chapter 2 -Rules of Construction and Definitions <br />EXTRACTION OF EARTH PRODUCTS- Mining activities as defined in N.C. General Statute 74- <br />49; summarized as the breaking of surface soil in order to remove minerals, ore, or other solid <br />materials. <br />FABRICATION- Building structures by cutting, bending, and assembling pieces. <br />FAMILY- For purposes of this Ordinance, family shall be defined as an individual or two or more <br />persons related by blood, marriage or adoption, living together in a dwelling unit; or a group of <br />not more than five persons who need not be related by blood, marriage, or adoption, living <br />together in a dwelling unit. A "family" may include five or fewer foster children. <br />FAMILY CARE HOME- A home with support and supervisory personnel that provides room and <br />board, personal care, and rehabilitation services in a family environment for not more than six <br />(6) resident elderly or handicapped persons. "Handicapped person" means a person with a <br />temporary or permanent physical, emotional, or mental disability including but not limited to <br />mental retardation, cerebral palsy, epilepsy, autism, hearing and sight impairments, emotional <br />disturbances, and orthopedic impairments but not including mentally ill persons who are <br />dangerous to others, as defined in North Carolina General Statute §V22C- 3(11)b. Such <br />iaciiiiies are Permitted in AO, CR, Lurk, viDK, HDR and L(- - �r as required by the Fair <br />Housing Act (42 U.S.C. §3602 et seq.) <br />FARM, BONA FIDE- The produ 'on d activities relating to or incidental to the production <br />of crops, fruits, vegetables, or I and flowering plants, dairy, livestock, poultry, and <br />all other forms of agriculture'as 'efined in North Carolina General Statute § 106 - 581.1. For <br />purposes of determining whether 'a property is being used for bona fide farm purposes, any <br />of the following shall constitute sufficient evidence that the property is being used for bona <br />fide farm purposes: <br />a. A farm sales,tax exemption certificate issued by the Department of Revenue. <br />b. A C dp� of the property tax listing showing that the property is eligible for <br />ion in the present use value program pursuant to North Carolina <br />e I Statute § 105 - 277.3. <br />C. ropy of the farm owner's or operator's Schedule F from the owner's or <br />d` o erator's most recent federal income tax return. <br />A forest management plan. <br />A Farm Identification Number issued by the United States Department of <br />Agriculture Farm Service Agency. <br />FARMER'S MARKET- A place where produce is brought for the purposes of retail sales. <br />There may be more than one seller per parcel of land.
