Cabarrus County Zoning Ordinance <br />Chapter 7- Performance Based Standards <br />Fireworks Stand- <br />Fireworks Stands are permitted in LC and GC zoning districts only for up to 45 days per <br />calendar year. A maximum of one (1) structure, not to exceed 120 square feet in area, <br />shall be allowed. The structure must be portable and completely removed at the end of the <br />permit period. Any sale of fireworks shall be regulated in accordance with NCGS 14 -410 <br />and 14 -414 and NC Fire Code (2009 Edition) Section 3308.11. <br />Seasonal Sale of Agriculture Products (Includes Christmas Trees and Pumpkins) <br />Seasonal Sales permitted in OI, LC, GC and LI zoning districts only. Limited to a period of <br />time not to exceed four (4) consecutive months per calendar year. A maximum of one (1) <br />building or display booth shall be allowed and may cover a maximum of 400 square feet. <br />Display area shall not interfere with emergency ingress /egress or with required parking. The <br />structure must be portable and completely removed when the permit expires. <br />Itinerant Merchants <br />The sale of food, beverages, or merchandise from a stand, motor vehicle or from a person <br />may be allowed in the LDR, MDR, HDR, LC and GC zoning districts at existing business sites. <br />Temporary stand, vehicle, display area, etc. shall not interfere with emergency <br />ingress /egress, sight triangles or required parking. The permit shall be limited to a period <br />not to exceed ninety (90) continuous days per calendar year at a given location. The 90 <br />days starts at date of issue and does not exclude days that the vendor is not on site. <br />Promotional Activities Involving the Display of Goods or Merchandise <br />Such activities may be conducted at a business for a period of not more than fifteen (15) <br />consecutive days. Merchandise and display area shall not interfere with emergency <br />ingress /egress, sight triangles or required parking. If a private sidewalk or pedestrian way <br />in front of the building is used for display of merchandise, a minimum width of four (4) feet <br />must remain unobstructed for pedestrian use. A Temporary Use Permit for promotional <br />activities may be renewed four times during any calendar year, for a maximum of 60 days <br />per calendar year. <br />REAL ESTATE DEVELOPMENT AND CONSTRUCTION RELATED <br />Contractor Office, Construction Equipment Storage <br />Accessory to an active Construction Project, permitted in any zoning district. Placement of <br />such temporary use is limited to a period of time determined by an estimated project <br />completion date. The permit may be extended for up to one year if approved by the <br />Administrator. A construction trailer or modular unit may be used as a contractor's office or <br />for the storage of equipment or materials. In the event that multiple builders are involved <br />in a new construction project, one construction trailer or temporary modular unit may be <br />permitted per builder for office or for storage. All temporary buildings and trailers shall be <br />completely removed from the site within thirty (30) days of the Certificate of Occupancy <br />being issued for the project. <br />Chapter 7 Page 35 of 39 <br />Attachment number 4 <br />G -1 Page 230 <br />
