CABARRUSCOUNTY <br />RESERVATION OF CAPACITY CERTIFICATE <br />BROOKDALE COMMONS <br />Pursuant to the authority granted to Cabarrus County by the North Carolina General <br />Assembly as expressed specifically in N.C. Gen. Stat. § 153A -320 N.C. Gen. Stat. § 153A- <br />331, N.C. Gen. Stat. § 15A -340, Session Law 2004 -39 (as applicable) and Article 15 of <br />the Cabarrus County Zoning Ordinance, the Cabarrus County Board of Commissioners, <br />at its regular meeting on April 16th, approved issuance of this Reservation of Capacity <br />Certificate to Lennar Carolinas, LLC for Brookdale Commons, which is a residential <br />development consisting of 230 lots on approximately 109 acres located near the <br />intersection of Rocky River Road and Savannah Road in the Town of Harrisburg. <br />This Certificate of Reservation of Capacity is issued pursuant to the following conditions <br />contained in the Ordinance and approved by the Board of Commissioners: <br />1. This Certificate applies to development of no more than 230 single - family lots on <br />the following parcel: 5506 -55 -2415. <br />2. Lennar Carolinas, LLC shall adhere to the following build out schedule: <br />In 2012, no more than 48 residential lots platted; <br />In 2013, no more than 77 residential lots platted; <br />In 2014, no more than 52 residential lots platted; <br />In 2015, no more than 53 residential lots platted. <br />Lennar Carolinas, LLC shall pay the Voluntary Mitigation Payment of $7631.00 <br />per lot, payable prior to final platting. <br />4.
