I <br />Drawn By and Return to Concord City Attorney <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br />PIN 4 5620 -21 -1889 & 5620 -22 -9833 <br />Grant of Permanent Greenway Easement and <br />Grant of Permanent Sanitary Sewer Easement <br />C <br />1 <br />The undersigned Grantors, Cabarrus County, a body politic and political subdivision of the State of North Carolina and <br />Habitat for Humanity Cabarrus County, Inc., a North Carolina Corporation non - profit corporation, in consideration of <br />payment to the Grantor of the sum of One Dollar, ($1.00), the receipt and sufficiency of which is hereby acknowledged, <br />does hereby grant, bargain, sell and release unto the City of Concord, a North Carolina municipal corporation <br />( "Grantee "), its successors, assigns and licenses, the right, privilege and easement to enter and re -enter at any time for <br />public active or passive green space, greenway, park, and recreational purposes, to install, dig, build, erect, maintain, <br />repair, rebuild, operate, and patrol said green space, greenway, or park, and the right, privilege and permanent easement <br />to enter and re -enter at any time to install, dig, build, erect, maintain, repair, rebuild, operate, and patrol any necessary <br />utilities that may be needed for such green space, greenway, or park, including but not limited to, the right to install, dig, <br />build, erect, maintain, repair, rebuild, operate and patrol sanitary sewer public utilities, including but not limited to, the <br />right to install sewer pipes and related appurtenances; the right to clear the all easements and keep said easements clear <br />of brushes, trees, buildings, obstructions, and fire hazards; and the right to remove trees, if any, located beyond the limits <br />of the easements, but which interfere with the easements; the above described rights being incident to performance by <br />the Grantee of its functions as a municipality, or the performance by any licensee of the Grantee of a public function, the <br />premises to be being located in No. 11 Township, Cabarrus County, North Carolina, and described in the metes and <br />bounds description below: <br />Lying and being in the City of Concord, No. 11 Township, Cabarrus County, North Carolina, crossing a portion of the <br />t property of Habitat for Humanity Cabarrus County, Inc., as shown in Book 9392, Page 37 (PIN 5620 -22 -9833 & PIN <br />5620 -21- 1889), as recorded among the Cabarrus County Register of Deeds; and being more particularly described as <br />follows: <br />A 40' Wide Permanent Sanitary Sewer Easement and Permanent Greenway Path Easement: <br />Commencing at an existing 5/8" bent iron situated on the west right -of -way line of Brown Street, S.W. (80' Wide Public <br />Right -of -Way), said point having N.C. Grid (NAD /83) ground coordinates of North 602,825.5409 U.S Survey Feet, East <br />1,523,296.7196 U.S Survey Feet; thence running with a Tie Line, North 35 °39'16" West 198.86 feet (1-6) to the Point of <br />Beginning (POB) of the 40' Wide Permanent Sanitary Sewer Easement to be described herein, said point being situated <br />on the western right -of -way line of Brown Street, S.W. (80' Wide Public Right -of -Way), as shown on Map Book 25, <br />' Page 14; thence leaving the Point of Beginning and running across Deed Book 9392, Page 37 (PIN 5620 -22 -9833 & PIN <br />5620 -21- 1889), <br />1.
