j <br />across that portion of Grantor's Property more particularly depicted and described in <br />Exhibit C attached hereto and incorporated herein: <br />a. Utility and Access Easement Grantor hereby grants, for the benefit of <br />Grantee's Property, a permanent, non - exclusive easement over, upon, within and across <br />that portion of Grantor's Property more particularly depicted and described in Exhibit B- <br />1 & B -2 attached hereto and incorporated herein ( "Utility & Access Easement ") for the <br />purpose of (i) vehicular and pedestrian egress and ingress and, in furtherance of the <br />aforementioned, for the purpose of, as necessary, constructing, installing, replacing, <br />repairing and /or maintaining a paved roadway, including any necessary or required <br />turning lanes, for the benefit of Grantee's Property and (ii) constructing, installing, <br />operating, replacing, repairing and /or maintaining such pipes, lines, wires, conduits <br />and /or other utilities improvements reasonably necessary for Grantee to access, connect <br />with and use the existing pipes, lines, wires, conduits and /or other utilities located within <br />Grantor's Property for the benefit of Grantee's Property; <br />b. Access Easement Grantor hereby grants, for the benefit of Grantee's <br />Property, a permanent, non - exclusive easement over, upon, within and across that portion <br />of Grantor's Property more particularly depicted and described in Exhibit B -1 & B -2 <br />attached hereto and incorporated herein ( "Access Easement ") for the purpose of <br />vehicular and pedestrian egress and ingress and, in furtherance of the aforementioned, for <br />the purpose of, as necessary, constructing, installing, replacing, repairing and /or <br />maintaining a paved roadway, including any necessary or required turning lanes, for the <br />benefit of Grantee's Property; <br />C. Drainage Easement Grantor hereby grants, for the benefit of Grantee's <br />Property, a permanent, non - exclusive easement over, upon, within and across that portion <br />of Grantor's Property more particularly depicted and described in Exhibit B -1 & B -2 <br />attached hereto and incorporated herein ( "Drainage Easement ") for the purpose of <br />constructing, installing, operating, replacing, repairing and /or maintaining such pipes, <br />lines, wires, conduits and /or other utilities improvements, including without limitation, a <br />drainage /retention pond to collect stormwater and otherwise handle the drainage of water <br />from Grantee's Property, reasonably necessary for Grantee to access, connect with and <br />use the existing pipes, lines, wires, conduits and /or other utilities located within Grantor's <br />Property for the benefit of Grantee's Property; and <br />d. Utility Easement Grantor hereby grants, for the benefit of Grantee's <br />Property, a permanent, non - exclusive easement over, upon, within and across that portion <br />of Grantor's Property more particularly depicted and described in Exhibit B -1 & B -2 <br />attached hereto and incorporated herein ( "Utility Easement ") for the purpose of <br />constructing, installing, operating, replacing, repairing and /or maintaining such pipes, <br />lines, wires, conduits and /or other utilities improvements reasonably necessary for <br />Grantee to access, connect with and use the existing pipes, lines, wires, conduits and /or <br />other utilities located within Grantor's Property for the benefit of Grantee's Property. <br />WCSR 4412262v1 <br />Attachment number 1 <br />k <br />�1 <br />F -4 Page 59 3 <br />
