STATE OF NORTH CAROLINA <br />COUNTY OF WAKE <br />NORTH CAROLINA <br />DEPARTMENT OF TRANSPORTATION <br />and <br />CABARRUS COUNTY <br />NONURBANIZED AREA <br />PUBLIC TRANSPORTATION <br />GRANT AGREEMENT FOR <br />PUBLIC BODY <br />JOB ACCESS AND REVERSE COMMUTE <br />PROGRAM — SECTION 5316 <br />CFDA NUMBER: 20.516 <br />PROJECT NUMBER: 11 -JA -042 <br />THIS AGREEMENT made this the day of , 20_, (hereinafter referred to as <br />AGREEMENT) by and between the NORTH CAROLINA DEPARTMENT OF <br />TRANSPORTATION (hereinafter referred to as Department ` , an agency of the State of North <br />Carolina) and CABARRUS COUNTY, (acting in its capacity as the designated Section 5316 <br />recipient hereinafter referred to as the "Contractor "). <br />WHEREAS, Chapter 53 of 49 U.S.C. app 5316 et seq. provides federal formula public <br />transportation funds for administrative, operating and capital purposes to assist private or <br />designated public nonprofit agencies in providing access to employment and employment <br />related activities for low income and welfare individuals. <br />WHEREAS, Article 26 of Chapter 136 of the North Carolina General Statutes (N.C.G.S.) <br />designated the Department of Transportation as the agency of the State of North Carolina <br />responsible for administering all Federal and /or State programs relating to public <br />transportation, and granted the Department authority to do all things required under applicable <br />Federal and /or State legislation to properly administer the public transportation within the State <br />of North Carolina; and <br />WHEREAS, the Governor of North Carolina, in accordance with Section 5316 of the <br />Safe, Accountable, Flexible, and Efficient Transportation Equity Act - A Legacy for Users <br />(SAFETEA -LU), Public Law 109 -59, August 10, 2005, and the Transportation Equity Act for <br />the 21 Century (TEA -21), Public Law 105 -178, June 1998, as amended,' has designated the <br />North Carolina Department of Transportation as the agency to receive and administer Federal <br />funds under this program; and <br />WHEREAS, the Contractor has been designated as the recipient of 49 U.S.C. 5316 <br />funds, and <br />WHEREAS, in order to assist in providing transportation services, the Department, under <br />the terms of this Agreement shall make grants for operating, capital and Administrative <br />assistance to the Contractor; and <br />WHEREAS, the Department and the Contractor desire to secure and utilize Section <br />5316 grant funds and State funds for the above referenced purposes. <br />NOW, THEREFORE, in consideration of the mutual covenants herein set forth, the <br />Department and the Contractor agree as follows: <br />Section 1. Purpose of Agreement The purpose of this Agreement is to provide the terms, <br />conditions, guidance and mutual undertakings of each party for the implementation of the 5316 <br />program. This agreement outlines the project and services and the manner in which the <br />Project will be undertaken and completed to meet the transportation needs for low income <br />individuals for employment.
