NORTH CAROLINA CONTRACT TO PROVIDE TAX DISTRICT FIRE <br />SERVICE <br />CABARRUSCOUNTY <br />This contract made and entered into this 1st day July of 2011, by and between the City of <br />Concord (CITY), a municipal corporation, and the County of Cabarrus (COUNTY); <br />WITNESSETH, that WHEREAS <br />That for and in consideration of the mutual covenants hereinafter contained, and pursuant to <br />authority granted by G.S. 69 -25.5, G.S. 69 -25.6, G.S. 160A -293, G.S. 160A -461 and G.S. 153A- <br />233, the CITY and COUNTY do hereby covenant and agree as follows: <br />1. Concord has exercised its statutory rights under the law to annex additional areas into <br />its City limits; and <br />2. Some of the additional annexed areas are in the portion of the County presently within <br />the boundaries of the Jackson Park Rural Fire Protection Tax District; and <br />3. The County currently contracts with Jackson Park VFD for fire service throughout the <br />Jackson Park Rural Fire Protection Tax District, and for that service a fire service tax has been <br />levied upon the Jackson Park Rural Fire Protection Tax District, and <br />4. Because of the annexations, the area and tax base which will remain within the <br />Jackson Park VFD fire tax district will decease to a point where continuing the fire service of the <br />Jackson Park VFD will soon become impracticable. <br />5. The COUNTY agrees to annually levy and collect upon all taxable property lying <br />within the COUNTY boundaries of the Jackson Park Rural Fire Protection Tax District an ad <br />valorem property tax equal to .05 cents per one hundred ($100.00) valuation, and after deduction <br />of the COUNTY's administrative charge (1 ''V2 %) for collection of such taxes, to pay the same to <br />the CITY. All monies collected will be paid to the CITY regardless of actual dollars budgeted. <br />6. The Tax Collector of the COUNTY shall collect the ad valorem taxes so levied and <br />shall make payments of the same to the CITY monthly as collections are made. <br />7. The CITY agrees to furnish and provide continuing fire protection service to all <br />property lying within the Cabarrus County boundaries of the Jackson Park Rural Fire Protection <br />District by dispatching upon call any or all of its equipment and adequate personnel to operate <br />same. The CITY shall furnish fire protection services in a professional and efficient manner as to <br />meet the requirements of and comply with rules and regulations of the NC Office of State Fire <br />Marshal, other pertinent federal, state, COUNTY laws, regulations, and standards not inconsistent <br />the CITY'S ordinances, regulations and standards. The CITY agrees to operate within the <br />guidelines set forth in Article II of Chapter 34 Fire Prevention and Protection of the Cabarrus <br />County Code of Ordinances, attached to this contract, as such Ordinances are not inconsistent <br />with the CITY'S ordinances. The County will continue to be responsible for fire prevention <br />activities, inspections and investigations for the rural district. <br />8. The CITY shall participate, within the limits of its resources and capabilities and with <br />deference to its primary responsibility, in any county -wide, or county - municipality mutual aid or <br />F -9 Page 229 <br />
