M. <br />AGENDA CATEGORY: <br />New Business <br />SUBJECT: <br />Commerce Dept. -Consent Agreement for Hawthorne Subdivision Project <br />BRIEF SUMMARY: <br />The applicant is Sterling Real Estate Development of North Carolina, LLC, <br />401 S. Tryon Street, Suite 2600, Charlotte NC, 28202. The project <br />consists of 104 single family residential lots on +/- 82.03 acres located on <br />Peach Orchard Road in the Town of Harrisburg. The project received <br />preliminary plat approval from the Town of Harrisburg Planning and <br />Zoning Board on November 21, 2006. A one year preliminary plat <br />extension was granted on November 21, 2008. A Consent Agreement is <br />required for the project to proceed. <br />REQUESTED ACTION: <br />Consider approval of the Consent Agreement between Cabarrus County <br />and Sterling Real Estate Development of North Carolina, LLC 'for the <br />Hawthorne subdivision, including the payment of $6,000 per lot to <br />advance school adequacy with payment due at final platting.
