DRAFT <br />STATE OF NORTH CAROLINA INTERLOCAL AGREEMENT <br />FOR 911 CALL CENTER EQUIPMENT <br />COUNTY OF CABARRUS <br />This INTERLOCAL AGREEMENT ("Agreement"), permitted by N.C. Gen. Stat. <br />§ 160A-460 et seq., is made as of , 2010 by and between CABARRUS <br />COUNTY, ("County") and the CITY OF CONCORD, North Carolina ("City"). <br />PREMISES <br />1. The County owns and operates a 911 call center, with networked locations <br />in the County Sheriff's Department administration building and in the County DSS <br />facility. <br />2. The City owns and operates its own 911 call center. <br />3. The County has recently upgraded its 911 call center equipment to the <br />Positron 911 system. <br />4. The County desires to install the Positron 911 system in the City's 911 call <br />center and to provide training for the City's employees in the usage of such equipment. <br />5. The City desires to utilize the Positron 911 equipment (the "Equipment") <br />for its 911 call center and to coordinate with the County on an integrated 911 system for <br />both local governments. <br />In consideration of these Premises and the Terms contained below, which the <br />parties agree constitute sufficient consideration to make this Agreement legally binding <br />and enforceable, the parties agree as follows: <br />TERMS <br />1. The County hereby loans to City and City hereby accepts possession of the <br />Equipment. <br />2. This loan of the Equipment shall be considered a bailment for the mutual <br />benefit of County (bailor) and the City (bailee). <br />3. No rent or other fee shall be paid by City to County for use by the City of <br />the Equipment and no storage fee or other amount shall be paid by County to City for <br />storage and maintenance of the Equipment. <br />4. The City may use the Equipment for its needs consistent with the normal <br />functions of the Equipment and shall deploy the Equipment as requested by the County. <br />Page 1 of 2 <br />F_~ A~~c,~~n~~t number 2 <br />
