STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br />SEWER SYSTEM AGREEMENT <br />This SEWER SYSTEM AGREEMENT ("Agreement") is made effective this <br />day of , 2010, by and between CABARRUS COUNTY, a political <br />subdivision of the State of North Carolina, ("County") and the CITY OF CONCORD, a <br />North Carolina municipal corporation ("City"). <br />PREMISES <br />1. The County now has approximately $235,000.00 that it collected as a <br />result of the Northwest Cabarrus County Fee (the "Northwest Fee") which the County <br />had required from developers for lots receiving water and sewer service in that portion of <br />Cabarrus County known as the Northwest Area. <br />2. The Northwest Fee was collected for the purpose of a Water and Sewer <br />Capital Improvement Fund designated to provide grants for the extension of new lines or <br />upgrading existing lines within the Northwest Area of the County. <br />3. The County utilized some of these funds for construction by the City of <br />Concord water distribution mains in the vicinity of Moss Drive pursuant to a Water <br />Distribution System Agreement dated May 21, 2007. <br />4. The County and City desire to allow the City to use some of the remaining <br />Northwest Area Funds for a sewer project in the Northwest Area. <br />5. The County wishes to contract with the City to construct a sanitary sewer <br />line to serve the properties contiguous to Pokeberry Trail in the Poplar Trails subdivision <br />in the Northwest Area (Pokeberry Trail Sewer Line"). <br />6. The County agrees to fund the acquisition of easements and the <br />construction of the Pokeberry Trail Sewer Line in exchange for the City's agreement to <br />prepare all right-of--way documentation, secure all property rights (including but not <br />limited to Eminent Domain litigation), prepare engineering plans and all specifications <br />needed for the improvements, provide contract administration, and construction <br />management of the project. <br />7. The County and the City desire to enter into this Agreement as a <br />prerequisite to the City's extension of sanitary sewer services to the Pokeberry Trail area <br />and ownership of such sanitary sewer system improvement. <br />In consideration of the above Premises and other good and valuable consideration, <br />which the parties agree make this Agreement legally enforceable, County and City agree <br />as follows: <br />Attachment number 1 <br />F-1 Page 47 <br />
