Williams, Esq. <br />Mail after recording to: Grantee <br />Excise Tax: $ 0 <br />NORTH CAROLINA <br />CABARRUSCOUNTY <br />WARRANTY DEED <br />THIS DEED made this day of , 2010, by Cabarrus County, a <br />body politic and political subdivision of the State of North Carolina, whose address is PO Box 707, <br />Concord, North Carolina, 28026 -0707 ( "Grantor "), to Habitat for Humanity Cabarrus County, Inc. <br />( "Grantee "), whose address is PO Box 1502, Concord, North Carolina 28026 -1502. <br />The designation Grantor and Grantee as used herein shall include said parties, their heirs, successors, <br />and assigns, and shall include singular, plural, masculine, feminine or neuter as required by context. <br />WITNESSETH: <br />That the Grantor, for a valuable consideration paid by the Grantee, the receipt of <br />which is hereby acknowledged, has bargained and sold, and by these presents does bargain, sell, and <br />convey unto the Grantee in fee simple, all that certain lot or parcel of land situated in No. Eleven <br />(11) Township, Cabarrus County, North Carolina, and more particularly described as follows: <br />See Exhibit A attached hereto and incorporated herein by reference. <br />This is part of that property conveyed to Cabarrus County by deed recorded in Book 86, <br />page 288, Cabarrus County Registry. <br />This property is being conveyed pursuant to that certain Resolution passed by the <br />Board of Commissioners for Cabarrus County dated pursuant to NCGS Section <br />153A- 378 and section 160A -279. <br />TO HAVE AND TO HOLD the aforesaid tract or parcel of land and all privileges <br />and appurtenances thereunto belonging to the Grantee in fee simple. <br />The Grantor does hereby covenant that Grantor is seized of the premises in fee <br />simple, has the right to convey the same in fee simple, that title is marketable and free and clear of all <br />encumbrances, and that Grantor will warrant and defend the title against the lawful claims of all <br />persons whomsoever except for the exceptions hereinafter stated. The title to the property <br />hereinabove described is subject to the following exceptions: <br />1. Right of Way to the State Highway Commission recorded in Book 370, page 578; <br />2.
