CABARRUS COUNTY <br />BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />SEPTEMBER 20, 2010 <br />6:30 P.M. <br />AGENDA CATEGORY: <br />New Business <br />SUBJECT: <br />Commerce - Consent Agreement and School Capacity Information for <br />Deer Run Phase 3 Subdivision <br />BRIEF SUMMARY: <br />The applicant is Summerhill Developers, Inc.,14675 Hopewell Church <br />Road, Midland, NC 28107. The request is for 14 single family residential <br />lots on +/- 22.93 acres located on White Tail Lane in the Town of Midland, <br />North Carolina. The project received preliminary plat approval from the <br />Town of Midland Planning and Zoning Board on June 3, 2008. A Consent <br />Agreement is required for the project to proceed. Based on the original <br />date of preliminary plat submittal, the Voluntary Mitigation Payment <br />is generated from the pre- August 2007 ordinance. <br />REQUESTED ACTION: <br />Motion to consider approval of the Consent Agreement between Cabarrus <br />County and Summerhill Developers, Inc. for the Deer Run Phase 3 <br />subdivision project, including the payment of $4,034.00 per lot to advance <br />school adequacy with payment due prior to final platting.
