CABARRUS COUNTY <br />BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />SEPTEMBER 20, 2010 <br />6:30 P.M. <br />AGENDA CATEGORY: <br />New Business <br />SUBJECT: <br />Commerce - Consent Agreement and School Capacity Information for <br />Savannah Commons Subdivision <br />BRIEF SUMMARY: <br />The applicant is Landmark Development Ventures, LLC, P.O. Box 5308, <br />Concord, NC 28027. The request is for 28 single family residential lots on <br />+/- 11.35 acres located off Pitts School Road in the City of Concord, North <br />Carolina. The project received preliminary plat approval from the City of <br />Concord Planning and Zoning Board on December 21, 2004. A Consent <br />Agreement is required for the project to proceed. Based on the original <br />date of preliminary plat submittal, the Voluntary Mitigation Payment <br />is generated from the pre- August 2007 ordinance. <br />REQUESTED ACTION: <br />Motion to consider approval of the Consent Agreement between Cabarrus <br />County and Landmark Development Ventures, LLC for the Savannah <br />Commons subdivision project, including payment of $1,008.00 per lot to <br />advance school adequacy with payment to be made in a lump sum of <br />$28,224.00 upon execution of the Consent Agreement and prior to any <br />permits being issued for the project.
