RESOLUTION DELEGATING AUTHORITY TO CERTAIN <br />MUNICIPAL GOVERNING BODIES <br />TO APPROVE ISSUING PERMITS FOR PYROTECHNICS <br />WHEREAS, in accordance with NCGS §14- 413(a), the <br />Cabarrus County Board of Commissioners must approve the <br />use of pyrotechnics in Cabarrus County; and <br />WHEREAS, NCGS 914- 413(a1) allows the Board of <br />Commissioners to authorize the governing body of any city in the County to issue permits for <br />pyrotechnics to be exhibited, used or discharged within the corporate limits of such city. <br />THEREFORE, BE IT RESOLVED, that the Cabarrus County Board of Commissioners does <br />hereby delegate to the governing bodies of the City of Kannapolis (in Cabarrus County only), the <br />City of Concord, and the Town of Harrisburg, the County's authority to issue permits for <br />pyrotechnics to be exhibited, used, or discharged within the corporate limits of each such city, <br />pursuant to the provisions of NCGS 14 -413 (a1) and (b). <br />BE IT FURTHER RESOLVED, that the Cabarrus County Fire Marshal is still authorized to <br />determine the issuance of permits for pyrotechnics to be exhibited, used or discharged inside <br />all other municipal jurisdictions within Cabarrus County and in the unincorporated areas of the <br />County. <br />BE IT FURTHER RESOLVED, that this resolution shall remain in effect until modified or <br />rescinded by the Cabarrus County Board of Commissioners. Nothing in this resolution shall be <br />deemed to expand the authority of any city within the County to issue permits beyond that <br />authority granted in NCGS §14 -413 or the North Carolina Fire Code. <br />Adopted this 18 day of October, 2010. <br />H.
