Return to Concord City Attorney, PO Box 308, Concord, NC 28026 <br />STATE OF NORTH CAROLINA ) Parcel Pin #'s 5548 -79 -3891 <br />COUNTY OF CABARRUS <br />Grant of Greenway Permanent Easement <br />and Temporary Construction Easement <br />The undersigned Cabarrus County, a body politic and political subdivision of the State of North <br />Carolina, Grantor, in consideration of payment to the Grantor of the sum of One Dollar, ($1.00), the <br />receipt and sufficiency of which is hereby acknowledged, does hereby grant, bargain, sell and release <br />unto the City of Concord, a North Carolina municipal corporation ( "Grantee "), its successors, assigns <br />and licensees, the right, privilege and easement to enter and re -enter at any time for public active or <br />passive greenspace, greenway, park, and recreational purposes, to install, dig, build, erect, maintain, <br />repair, rebuild, operate, and patrol said greenspace, greenway, or park, and the right, privilege and <br />permanent easement to enter and re -enter at any time to install, dig, build, erect, maintain, repair, <br />rebuild, operate, and patrol any necessary utilities that may be needed for such greenspace, greenway, <br />or park, including but not limited to, one or more underground electric power distribution lines, and /or <br />other public utilities, and one or more underground telephone, cable television, fiber optic or <br />communications line(s), including but not limited to, the right to erect poles and other distribution line <br />structures, wires, cables, pipes, and any necessary appurtenances for the proper conduct of electricity , <br />electronic information, data, communications, water, sewer, stormwater, and any other public utilities; <br />the right to clear the easement and keep it clear of brushes, trees, buildings, obstructions, and fire <br />hazards; and the right to remove trees, if any, located beyond the limits of the easement, but which <br />interfere with the easement; the above described rights being incident to performance by the Grantee of <br />its functions as a municipality, or the performance by any licensee of the Grantee of a public function, <br />the premises being located in No. 3 Township, Cabarrus County, North Carolina, and described in the <br />metes and bounds description below: <br />Lying and being in the City of Concord, No. 3 Township, Cabarrus County, North Carolina, crossing a <br />portion of the Cabarrus County Property (PIN 4681 -15 -7264) as recorded in Deed Book 3159, Page 61 <br />among the Cabarrus County Register of Deeds; and being more particularly described as follows: <br />A 30' Wide Permanent Path Easement: <br />Commencing from an existing iron rod situated at the common corner of Lot #782 of MOSS CREEK <br />VILLAGE, NAPA VALLEY, PHASE 5, MAP 5; recorded in Map Book 50, Page 73, among the Cabarrus <br />County Register of Deeds; and the Common Open Space Area recorded in Map Book 55, Page 17 <br />among the Cabarrus County Register of Deeds; said iron rod being further described as being located <br />on the line of aforesaid Cabarrus County Property (PIN 4681 -15 -7264) and running with the following tie <br />line along the common line of said Common Open Space and the Cabarrus County Property; South <br />Attachment number 1 <br />F -2 Page 80 <br />
