<br />The Grantor, does hereby grant, bargain, sell and release unto the City of Concord, a North
<br />Carolina municipal corporation ( "Grantee "), its successors, assigns or licensees two (2) temporary
<br />easements to enter and re -enter during the construction of the project entitled "Rocky River Greenway,
<br />Northwest Phase" (project # 2009 -049) in order to install, dig, build, erect, maintain, repair, rebuild,
<br />operate, and patrol said greenspace, greenway, or park, and the right, privilege and temporary
<br />construction easement to enter and re -enter at any time to install, dig, build, erect, maintain, repair,
<br />rebuild, operate, and patrol any necessary utilities that may be needed for such greenspace, greenway,
<br />or park, including but not limited to, one or more underground electric power distribution lines, and /or
<br />other public utilities, and one or more underground telephone, cable television, fiber optic or
<br />communications line(s), including but not limited to, the right to erect poles and other distribution line
<br />structures, wires, cables, pipes, and any necessary appurtenances for the proper conduct of electricity,
<br />electronic information, data, communications, water, sewer, stormwater, and any other public utilities in
<br />the rights -of -way immediately adjacent to and contiguous with these temporary construction easements,
<br />the above described rights being incident to performance by the Grantee of its functions as a
<br />municipality, or the performance by any licensee of the Grantee of a public function, the premises being
<br />located in No. 3 Township, Cabarrus County, North Carolina, and described in the metes and bounds
<br />description below:
<br />A 10' Wide Temporary Construction Easement (T .C.E.) (North
<br />Commencing from an existing iron rod situated at the common corner of Lot #782 of MOSS CREEK
<br />VILLAGE, NAPA VALLEY, PHASE 5, MAP 5; recorded in Map Book 50, Page 73, among the Cabarrus
<br />CW County Register of Deeds; and the Common Open Space Area recorded in Map Book 55, page 17
<br />among the Cabarrus County Register of Deeds; said iron rod being further described as being located
<br />on the line of aforesaid Cabarrus County Property (PIN 4681 -15 -7264) and running with the following tie
<br />line along the common line of said Common Open Space and the Cabarrus County Property; South
