STATE OF NORTH CAROLINA <br />AMENDMENT TO CONTRACT FOR <br />COUNTY OF CABARRUS CONSTRUCTION MANAGER AT RISK <br />THIS AMENDMENT TO CONTRACT FOR CONSTRUCTION MANAGER AT RISK <br />( "Amendment ") is made and entered into this day of November, 2010 by and between <br />CABARRUS COUNTY ( "Owner ") and CM BLACK CONSTRUCTION COMPANY, INC. <br />( "CM "). <br />The parties entered into a Contract for Construction Manager at Risk ( "Agreement') in <br />August, 2009 for the construction of the Cabarrus County Satellite Office — Phase I at the <br />intersection of Cabarrus Avenue and Union Cemetery Road in Concord, Cabarrus County, North <br />Carolina. <br />The parties desire by this document to amend the Agreement to change the location of the <br />Project and certain other matters in the Agreement related to the change in the Project. <br />In consideration of the above recitals and the terms and conditions contained below, the <br />parties agree as follows: <br />1. Throughout the Agreement at which the Project is defined, identified or referred to, <br />the Project shall now be the Cabarrus County Board of Elections new facility in the old Cabarrus <br />Creamery building located at 363 North Church Street, Concord, Cabarrus County, North Carolina. <br />All references to the Cabarrus County Satellite Office — Phase I and Site Work shall be deleted. <br />2. The text of Article 2 — The Project to be Built and Constructed shall be deleted in its <br />entirety, substituting in its place the following: <br />Scope of Work The CM agrees to provide the construction <br />management services herein described for the renovation and upfit <br />of the approximate 10,000 square foot office building formerly <br />known as the Cabarrus Creamery, as shown upon the drawings <br />prepared and to be prepared by Yates - Chreitzberg- Hughes Architects, P.A. <br />3. The text of Article 7 - Construction, Paragraph C shall be deleted in its entirety, <br />substituting in its place the following: <br />Proposal of Guaranteed Maximum Price — When the Drawings <br />and Specifications are sufficiently complete and the CM has obtained <br />responses to its request of bids, the CM shall propose a Guaranteed <br />Maximum Price, which shall be reflected in an Amendment to this Contract. <br />4.
