STATE OF NORTH CAROLINA TOWN OF HARRISBURG - <br />CABARRUS COUNTY <br />INTERLOCAL AGREEMENT REGARDING <br />COUNTY OF CABARRUS THE HARRISBURG AREA LAND USE PLAN <br />This INTERLOCAL AGREEMENT REGARDING THE HARRISBURG AREA LAND <br />USE PLAN ( "Interlocal Agreement"), is entered into effective December 31 2010 by, <br />between and among the TOWN OF HARRISBURG ( "Harrisburg ") a North Carolina <br />municipal corporation, CABARRUS COUNTY ("County"), a body politic and political <br />subdivision of the State of North Carolina, and the WATER AND SEWER DISTRICT <br />OF CABARRUS COUNTY, { "District "), a water and sewer district formed pursuant to <br />N.C. Gen. Stat. Chapter 162A. <br />PREMISES <br />1. The Town, the County and the District have been jointly involved in crafting a <br />land use plan for the "Harrisburg Area" of Cabamzs County, which comprises an area as <br />depicted in Exhibit A attached to this Interlocal Agreement. <br />2. This land use plan is termed the "Harrisburg Area Land Use Plan" <br />( "HALUP "). <br />3. The parties desire to enter into an agreement regarding the HALUP and for the <br />provision of utilities in Harrisburg's Utility Service Area. <br />In consideration of these Premises and the Terms below, and the provisions of N.C. Gen. <br />Stat. §160A -460 et seq., which the parties acknowledge make this Interlocal Agreement <br />binding and enforceable, the parties agree as follows. <br />TERMS <br />1. The parties agree to use their best efforts to jointly plan for growth in <br />Harrisburg's Utility Service Area, particularly in the geographic area included in the <br />HALUP and located outside of the Harrisburg's planning and zoning jurisdiction. Such <br />planning shall take into consideration the goals of fiscally responsible growth <br />management, rural preservation, protection of farmland, preservation of natural areas, <br />conservation, sustainable development and the impact of the extension of water and <br />sewer utility services with its resultant likely increase in development intensity in that <br />Area. No wording in this paragraph shall be construed to mean that the County has <br />acquired any additional powers to control, manage or direct growth in those areas within <br />the municipal boundaries of and the extraterritorial jurisdiction of Harrisburg. <br />2. The parties agree to jointly adopt the same HALUP for the Harrisburg Area <br />outside of the planning and zoning jurisdictions of the Harrisburg but only within the <br />Utility Service Area of Harrisburg.
