J <br />CABARRUS COUNTY <br />BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />JANUARY 20, 2009 <br />6:30 P.M. <br />C <br /> <br /> <br /> <br />AGENDA CATEGORY: <br />New Business <br />SUBJECT: <br />Commerce Department -Consent Agreement for the Wyndham Estates <br />Subdivision Project <br />BRIEF SUMMARY: <br />The applicant is Wyndham Estates, LLC, 1101 Lester Mullis Road, Indian <br />Trail, NC 280793. The project consists of 69 single family residential lots <br />on approximately 80.68 acres located on Old Camden Road. The project <br />received preliminary plat approval from the Town of Midland Planning and <br />Zoning Board on November 7, 2007. A Consent Agreement is required for <br />the project to proceed. Based on the date of submittal for preliminary <br />plat approval, the Voluntary Mitigation Payment is generated from <br />the pre-August 2007 ordinance. <br />REQUESTED ACTION: <br />Motion to consider approval of the Consent Agreement between Cabarrus <br />County and Wyndham Estates, LLC for the Wyndham Estates subdivision <br />project, including the payment of $4,034 per lot to advance school <br />adequacy with payment prior to final platting.
