1 <br />' ~ CABARRUS COUNTY <br />' ~ BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />' JANUARY 20, 2009 <br />6:30 P.M. <br /> <br />AGENDA CATEGORY: <br />Old Business <br />SUBJECT: <br />7 <br />_i <br /> <br />f <br />r <br />Commerce Department -Consent Agreement for the Edison Square <br />Condominium Project <br />BRIEF SUMMARY: <br />The applicant is Shea Homes, LLC, 3436 Toringdon Way, Suite 100, <br />Charlotte, NC 28210. The project consists of 168 condominium units on <br />+/-31.65 acres located at the intersection of Harris Road and Ellenwood <br />Drive. The project received site plan approval from the City of Concord <br />Planning and Zoning Board on June 20, 2006. A Consent Agreement is <br />required for the project to proceed. Based on the date of approval, <br />the Voluntary Mitigation Payment is generated from the pre-August <br />2008 ordinance. <br />Note: The Board took no action on this item at it's December meeting. <br />' REQUESTED ACTION: <br />Motion to consider approval of the Consent Agreement between Cabarrus <br />' County and Shea Homes, LLC for the Edison Square condominium <br />project, including the payment of $1,331 per lot to advance school <br />' adequacy with payment due prior to the issuance of building permits. <br />Authorize the County Manager to execute the Agreement on behalf of <br />Cabarrus County, subject to review or revisions by the County Attorney. <br />' EXPECTED LENGTH OF PRESENTATION: <br />' 5 Minutes <br />SUBMITTED BY: <br />' Kassie G.
