<br />CABARRUS COUNTY <br />BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />MARCH 16, 2009 <br />6:30 P.M. <br />AGENDA CATEGORY: <br />Consent Agenda <br />SUBJECT: <br />Commerce -Consent Agreement for the Roycroft Subdivision Project <br />BRIEF SUMMARY: <br />The applicant is TDW Holdings, LLC, 6707 Fairview Road, Suite B, <br />Charlotte, NC 28210. The project consists of 361 single family residential <br />lots on +/-262.42 acres located on Flowes Stores Road. The project <br />received preliminary plat approval from the Cabarrus County Planning and <br />Zoning Board on March 15, 2007. A one year extension was granted on <br />February 19, 2009 setting a new expiration date of March 15, 2010. The <br />existing Consent Agreement is set to expire on March 15, 2009. A <br />renegotiated or reaffirmed Consent Agreement is required for the project <br />to proceed. Based on the date of approval, the Voluntary Mitigation <br />Payment is generated from the pre-August 2007 ordinance. <br />REQUESTED ACTION: <br />Motion to approve the Consent Agreement between Cabarrus County and <br />TDW Holdings, LLC for the Roycroft subdivision project, including the <br />payment of $4,034 per lot to advance school adequacy with payment due <br />prior to final platting.
