<br />CABARRUS COUNTY <br />'~`~, BOARD OF COMMISSIONERS ' <br />REGULAR MEETING ' <br />~, MARCH 16, 2009 , <br />6:30 P.M. <br />AGENDA CATEGORY: <br />Consent Agenda <br />SUBJECT: i <br />Commerce -Interlocal Agreement Between Cabarrus County and the <br />Town of Midland <br />BRIEF SUMMARY: <br />Midland desires to contract with the County Planning & Zoning <br />Department to administer its Flood Damage Prevention Ordinance <br />(FDPO) within Midland's corporate limits and ETJ at no charge. However, <br />all fees collected through the administration of this Ordinance will belong <br />to and be collected by the County. Midland will hold the County harmless <br />should any claims arise from the provision of these services. All <br />development within Midland's corporate limits or ETJ shall be subject to i <br />the FDPO and no building permits will be issued until the flood zone is <br />determined and necessary building standards are met. Preliminary and <br />final elevation certificates will be required for property and/or structures <br />located within the Special Flood Hazard Area. The Planning & Zoning <br />Department will use every effort to enforce the FDPO except civil or <br />criminal action, which will be handled by Midland upon written notice from <br />the County. Finally, the effective date of the proposed agreement <br />is January 13, 2009 and termination requires a 45-day written notice. <br /> <br />REQUESTED ACTION: <br />Motion to approve the Interlocal Agreement between Cabarrus County <br />and the Town of Midland for administration of the Flood Damage <br />Prevention Ordinance. <br />EXPECTED LENGTH OF PRESENTATION: <br />SUBMITTED BY: <br />F - 3 Page 165 of 286 <br />
