<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />•Chapter Nine Landscaping and Buffering <br />1) Ongoing development projects. Development granted a building <br />permit prior to the date of the adoption of this Ordinance is exempt from the <br />requirements of this Chapter. <br />2j Where physical features preclude strict compliance. It is recognized <br />that, on occasion, complete compliance with the terms of this Chapter may be <br />impractical. Accordingly, a developer may request approval for an alternate <br />landscaping scheme when any one or combination of the below listed conditions <br />exist: <br />• The site involves space limitations or unusually shaped parcels; <br />• Topography, soil, vegetation, or other site conditions are such that full <br />compliance is impossible or impractical; <br />• Natural vegetation on the site, if undisturbed during the development <br />process, can meet or exceed the vegetation which is required; and/or, <br />• Safety considerations are involved. <br />' In order to have landscape requirements modified due to one or a <br />combination of the above, the applicant should submit a justification to the office <br />of the Zoning Administrator. Within the justification, the applicant must <br />describe: <br />i) which of the landscape requirements will be met with <br />modifications; <br />ii) which of the conditions set forth above justify using alternatives; <br />and <br />iii) how the proposed alternative meets or exceeds what is required. <br /> <br /> <br /> <br /> <br /> <br />1 <br /> <br />3) Approval of deviation. Deviations from the requirements of this <br />Chapter may be approved or disapproved by the Zoning Administrator as long as <br />the deviation does not exceed 30 percent of the written requirement. A variation <br />greater than 30 percent of any landscaping/buffer regulation must be heard by <br />the Planning & Zoning Commission acting as a Board of Adjustment. Deviations <br />granted within the scope of the authority of the Zoning Administrator shall be so <br />noted on the zoning compliance permit along with the reasons for allowing or <br />requiring the deviation. <br />Section 9-5. Landscape and Buffering Terms. <br />There are several important key landscape definitions to understand: <br />• Berm. An earthen mound designed to provide visual interest, <br />screen undesirable views and/or decrease noise. <br />• Buffer.
