1 <br /> <br />Triune Development, LLC <br />711 Charming Circle NW, Concord, NC 28027 <br />March 12, 2009 <br />Board of Commissioners <br />Cabar-us County <br />65 Church St. SE <br />Concord, NC 28026 <br />RE: Request for extension of Consent Agreement and request for payment of facility fee to be at <br />permitting for Castlebrooke Manor Subdivision <br />Dear Board of Commissioners, <br />We the developers, Triune Development, LLC request an extension of the consent agreement <br />for Castlebrooke Manor subdivisio-i located in the city of Kannapolis, NC on Jim Johnson Rd. <br />for (1) year, until August 10, 2009. Our existing consent agreement expired on August 10, 2008 <br />due to the sewer easement issue with the city of Kannapolis. We were granted a preliminary plat <br />extension and now we need a consent agreement extension. Our preliminary plat extension is <br />good until the August 10, 2009 date. <br />We have confirmation of the preliminary plat extension1 from Mr. Ben Warren with the city of <br />Kannapolis, due to the above mentioned issues. All work has been completed and we are ready <br />to -•ecord lots. <br />Your understanding and consideration of this matter is greatly appreciated. <br />Also, due to the extreme economic conditions with housing we would like to ask the Board of <br />Co-nmissioners to allow us to pay the adequate facility fee for the (28) lots in Phase 1 at building <br />permitting and the remaining 421ots we can paid at platting. We have been hit extremely hard <br />financially during this down economic time. This development is an upper end development that <br />will leave housing in the $700K and up bracket. There is no negative impact to the city and <br />county services until someone is actually living in the house. Up to that point the impact is <br />positive in that it raises the land value without using any services. <br />Our original consent agreement stated that the build out would be 27 lots in 2007, 151ots in <br />2008, 1S lots in 2009 and 13 lots in 2010. We are willing to restructure this build out as <br />followed: 28 lots in 2009, 15 lots in 2010, 15 lots in 2011 and 12 lots in 2012. <br />Again, anything you can do to help us through this difficult time is very much appreciated. <br />Sincerely, <br />~~~ ~ ~~ ((~~~~~,~1 <br />Calv-n R.
