<br /> General Assembly of North Carolina Session 2009 <br />1 ~ To purchase or finance real or personal property in the manner provided for t <br />2 cities and counties under G.S. 160A-20. <br />3 ~ With the approval of any unit of local government, to use officers, <br />4 employees agents and facilities of the unit of local government for the <br />5 purposes and upon the terms as may be mutually agreeable. <br />6 22 To issue obligations without Local Government Commission approval, to <br />7 finance the purchase or acquisition of land or options on land, or the <br />8 construction of buildings or facilities. An obligation may be secured by the <br />9 land purchased or acquired, or by the buildings or facilities constructed, may <br />10 be unsecured or may be made payable from revenues, the proceeds of notes, <br />11 bonds or the sale of any lands, the proceeds of any bonds of the State or <br />12 moneys appropriated by the State, or any other available moneys of the <br />13 Trust. An obligation to finance the purchase or acquisition of land or options <br />14 on land or the construction of buildings or facilities, maybe sold onl t <br />15 Escheat Fund as an investment of the Fund pursuant to G.S. 147-69.2(b)(11). <br />16 23 To receive and use appropriations from the State, including an appropriation <br />17 from the proceeds of State general obligation bonds or notes. <br />18 ~ To execute the powers provided in subsection (a) of this section, the Board shall <br />19 determine the policies of the Trust b~jority vote of the members of the Board present and <br />20 voting a quorum having been established. Once a policy is determined, the Board shall <br />21 communicate it to the executive director who shall have the sole and exclusive authorit~to <br />22 execute the polic y of the Trust. No member of the Board shall have the responsibility or <br />23 authority_to ig ve operational directives to any employee of the Trust other than the executive <br />24 director. <br />25 ~ If the Yadkin River Trust acquires the Yadkin Project as provided in this Article, in <br />26 addition to other r owers and duties, the Trust shall: <br />27 ~ Conduct environmental testing and assessment of all properties located in <br />28 <br />29 Stanly County currently or formerly owned and operated by Alcoa Power <br />Generating, Inc., or Alcoa, Inc., and its subsidiaries, in order to evaluate <br />30 dan eg r to public health or the environment. <br />31 ~ Require remediation of contamination at the Badin Works site located in <br />32 Stanly County to levels over and above the minimum levels that Alcoa or its <br />33 subsidiaries would be required to perform under current law in order to <br />34 restore the contaminated land and water to multiple use purposes. <br />35 ~ Establish a remediation fund to perform necessary environmental testin ag_nd <br />36 remediation of hazardous waste sites in the Yadkin River Basin, excluding +1 <br />37 properties owned or under the control of Alcoa Power Generating, Inc., or <br />38 Alcoa, Inc., and its subsidiaries. <br />39 ~, Install aeration technology in association with the Yadkin Project to increase <br />40 dissolved oxygen levels and improve water quality in the Yadkin River. <br />41 ~5,~ Institute operational changes to the Yadkin Project that will retain more <br />42 water in High Rock Lake and provide a consistent flow of water to <br />43 downstream water users. <br />44 ~ Extend the recreation season at Huh Rock Lake by three months from April <br />45 1 to October 31. <br />46 ~ Implement a comprehensive drought mans e~plan, or "Low Inflow <br />47 Protocol," that requires the Trust to reduce power generation and send less <br />48 water downstream when certain drought-related triggers are reached. <br />49 ~8,~ Develop and maintain new or expanded public recreation facilities across the <br />50 Yadkin River, including; a new public swim area in Rowan Coun ,new <br /> Attachment number 3 <br /> Page 6 5967 [~ai4 of 320 <br /> F-2 ' <br />
