<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />NORTH CAROLINA CONTRACT TO PROVIDE <br />CABARRUS COUNTY FIRE PREVENTION SERVICE <br />This contract is made and entered into this 11th day of August, 2008, by and between the <br />TOWN OF HARRISBURG, a North Carolina municipal corporation ("Town"), and the COUNTY OF <br />CABARRUS, a political subdivision of the State of North Carolina ("County"). <br />Inconsideration of the mutual covenants contained and pursuant to authority granted by <br />N.C. Gen. Stat. §§ 69-25.5, 69-25.6 and 153A - 233, the Town and County do covenant and <br />agree as follows: <br />1. The Town agrees to furnish and provide continuing fire prevention, education <br />service and inspections to all property located in the Harrisburg Rural Fire Protection <br />District {the "District") at no additional cost to the citizens in the district. <br />2. Under the authority of the County Fire Marshal's Office the Town may require <br />additional building plans be submitted for review. <br />3. The Town will assume any liability for and hold harmless the County for this service <br />within the District. The County shall be listed as an additional insure on the liability <br />policy in place by the Town. This shall be documented by providing the County with a <br />copy of the certificate of liability listing the County, and include the worker's <br />compensation coverage and commercial auto coverage policy of the Town. <br />4. All permit fees and fines assessed in the district shall be determined in accordance <br />with the Fine and Fee schedule approved by the County. This fee and fine schedule is <br />maintained and on fife with the Cabarrus County Fire Marshal's Office. All revenue <br />generated from fees or fines from the district shall be retained by the Town. <br />5. This Contract may be terminated by either party at any time by giving 180 days prior <br />written notice to the other party of the intention to terminate. in the event such notice <br />is not timely given, this contract shall be automatically renewed for an additional year. <br />This Contract maybe amended only in a written instrument executed by both parties. In <br />the event a provision of this Contract is determined to be inconsistent with any state or <br />local law, such provision shall be determined by both parties to be amended to confirm <br />with such state and local law without necessity of any further action by either party. <br />Attachment number 3 <br />' F - 3 Page 76 of 199 <br />
