1 <br /> <br />' City of Locust Cabarrus County <br />North Carolina North Carolina <br />' Interlocal Agreement Regarding Fire Code Enforcement <br />The Agreement made this 1St day of July, 2008, by and between Cabarrus County, a political <br />subdivision of the State of North Carolina, herein called, "County" and the City of Locust, a <br />' municipal corporation located in Cabarrus County and organized under the laws of the State of <br />North Carolina, herein "City". <br />' WITNESSETH: <br />WHEREAS, North Carolina Fire Prevention Code, formerly the North Carolina State Building <br />' Code Volume Five (V), hereinafter referred to as the Fire Code of the State of North Carolina, <br />became effective in the County and City January, 1997; and <br />' WHEREAS, County has adequate personnel to provide enforcement of the Fire Code for the <br />City as described herein; and <br />WHEREAS, N.C.G.S. Section 160A-461 and Section 153A-353 authorize counties and cities to <br />enter into interlocal agreements for carrying out joint inspection services; and <br />WHEREAS, the City has, by Resolution requested County to direct one or more of its inspectors <br />' to exercise their powers to enforce the Fire Code within the corporate limits of City, all in <br />accordance with N.C.G.S,160A-413. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />NOW, THEREFORE, in consideration of the mutual covenants set forth herein and other good <br />and valuable consideration, the receipt of which is hereby acknowledged, the parties agree as <br />follows: <br />1. The term of this Agreement shall be for one year beginning July 1, 2008 and ending June <br />30, 2009. Unless terminated as provided herein, this Agreement shall automatically <br />renew upon expiration of the first year or any subsequent year for a period of one <br />additional year. <br />2. Either party may terminate this Agreement by giving written notice to the other at least <br />thirty (30) days prior to the termination of the then cuiTent Agreement. <br />3. County, through its Fire Services, is designated as the agency to perform inspection <br />duties and responsibilities mandated by the Fire code within the corporate limits of City. <br />4. County Fire Services shall receive applications for all permits required by the Fire Code, <br />issue or deny permits, make necessary inspections, issue or deny certificates of <br />compliance, issue orders to correct violations, revoke permits, bring judicial action <br />against actual or threatened violations, keep adequate records and take other action as <br />may be necessary to enforce the Fire Code within the City. <br />5.
