1 <br /> <br />' ^ The CQA report will bear the seal of the project engineer and a certification that <br />construction was completed in accordance with the Contract Documents, approved <br />Closure Plan, and acceptable engineering practices. <br />' SCHEDULE <br />' The Engineer agrees to provide these services in accordance with the schedule defined in the <br />Construction Contract Documents for the subject project. Excused or unexcused delays on the <br />part of the construction Contractor that extend the contractual completion date will entitle <br />' Engineer to seek additional compensation for additional incurred costs attributable to that <br />delay. <br />t 2. The responsibility of OWNER as described in Section 4 of said Agreement are amended and <br />supplemented as follows: <br />' Review contractor submittals and deliverables in a timely manner. <br />3. The time period for the performance of ENGINEER'S services as set forth in Section 4 of said <br />' Agreement are amended as follows: <br />CDM will provide construction services during the 210-day closure construction project. <br />' 4. The method of payment for services rendered by ENGINEER as set forth in Item B of said <br />Agreement is amended and supplemented as follows: <br />' For the Basic Services performed by ENGINEER under Section 1 of this Amendment, OWNER <br />agrees to pay the Engineer for the services included under this Amendment as defined below. <br />For lump sum tasks, it is agreed that total costs per task summarized below do not represent <br />contractual upper limits per task. <br />Task 1.0 -General Services During Construction (lump sum) - $136,384 <br />Task 2.0 -Resident Project Representation (not-to-exceed) - $76,380 <br />Task 3.0 -CQA Monitoring Services (not-to-exceed) - $24,950 <br />Task 4.0 - NC DENR Site Inspection and CQA Report (lump sum) - $21,830 <br />' The maximum amount payable by the County to the Engineer as part of this Amendment is <br />Two Hundred Fifty-Nine Thousand Five Hundred and Forty-Four Dollars ($259,544). This fee <br />has been based on a construction period of 210 days (30 weeks) and the assumptions indicated <br />' herein. If these items vary or the scope changes from that which has been assumed, the Engineer <br />will be entitled to additional compensation. <br />The total lump sum fee for Tasks 1.0 and 4.0 is $158,214. The total not-to-exceed fee for Tasks 2.0 <br />and 3.0, based on a billing rate of $85.00 per hour, plus expenses, is $101,330. <br />' Total costs per task for billing rate tasks represent not-to-exceed amounts that will not be <br />exceeded without prior approval in writing from the County.
