Scope of Work: The CM agrees to provide the construction management services <br />herein described for the construction of site work; and an approximate 25,000 sq. ft. 2- <br />story office building; Parking and Site Developments shown upon the drawings prepared <br />and to be prepared by Yates-Chreitzberg-Hughes Architects, P. A. <br />ARTICLE 3 -CONSTRUCTION MANAGER AT RI K'S RESPONSIBILITIES <br />A. Professional Construction Management Services - The Construction <br />Manager at Risk shall furnish professional construction management services during the <br />design and construction of the Project. The Construction Manager at Risk accepts the <br />relationship of a fiduciary with the Owner. Further, the Construction Manager at Risk <br />covenants with the Owner to furnish and to provide reasonable skill and judgment and <br />to cooperate with the Architect in furthering the interest of the Owner. The Construction <br />Manager at Risk shall furnish construction administration and management services and <br />use the Construction Manager at Risk's best efforts to perform its obligations in an <br />expeditious and economical manner consistent with the interests of the Owner. <br />Additionally, the Construction Manager at Risk, within the requirements of the Contract <br />Documents and law, shall use its best efforts to ensure that companies which are <br />headquartered or based in Cabarrus County will have the opportunity to be awarded <br />subcontracts for this Project. <br />B. Public Bids -The Construction Manager at Risk shall publicly advertise for <br />bids from first tier Subcontractors as required by N. C. Gen. Stat. § 143-128.1 (c); and <br />shall pre-qualify and accept bids from first tier Subcontractors for all work upon the <br />Project. The pre-qualification criteria shall be determined by the Owner and the <br />Construction Manager at Risk to address quality, performance, the time specified in the <br />bids for performance of the Contract, the cost of construction oversight, time for <br />completion, capacity to perform and other factors deemed appropriate by the Owner. <br />C. Plan for Bid Solicitation -The Construction Manager at Risk shall submit its <br />plan for compliance with N. C. Gen. Stat. § 143-128.2 for approval by the Owner prior to <br />soliciting bids for the Project's first tier Subcontractors. The Construction Manager at <br />Risk and first tier Subcontractors shall make a good faith effort to recruit and to select <br />minority businesses for participation in contracts pursuant to the provisions of N. C. Gen. <br />Stat. § 143-128.2. <br />D. Pre-Qualification of Bidders -Subcontractors shall be pre-qualified by the <br />CM. The Owner and the CM shall determine the pre-qualification criteria. Only pre- <br />qualified contractors are allowed to bid and contract with the CM on the Project. To the <br />greatest extent practicable, the CM shall pre-qualify and encourage Subcontractors in <br />and around Cabarrus County, North Carolina to submit bids for various portions of the <br />work. Consistent with the requirements of the Contract Documents, the CM shall, in <br />good faith, provide an opportunity for such local Subcontractors to participate in the <br />construction of the Project. <br />6 <br />F-4 <br />Attachment number 1 <br />Page 152 of 627 <br />
